    1) i have a huge overdraft with Natwest if i get the money will they just pay it into my account or send me a cheque, or even refuse ?

    Hi there,

    I would be a little wary if you don't have another bank account set up elsewhere where you can move your banking/ovredraft to. They may, as some banks have lately, insist that your account be closed and any monies owed moved elsewhere. Be aware of this. Several people have had their charges paid into their bank accounts/credit card accounts, several have had it paid as a cheque. It is pot luck really. Sorry I can't be of any more help!?

    Hi folks, I was wondering if anyone here could possibly give me a sensible answer ?I started a new thread but was quite frankly shot down and made to feel a bit of an idiot by someone, i'm in a genuinly bad situation at the moment and just need a friendly chat :0My post is below :Well yesterday i sent off my firt letter to Natwest, the data protection one, so fingers crossed they will come up trumps Anyway my question is this..... well 2 actually.1) i have a huge overdraft with Natwest if i get the money will they just pay it into my account or send me a cheque, or even refuse ?2) are they supposed to advise youy when they are going to charge you for anything my bank never does, since April this year i have been charged now over £1000 and never been aware of it till i check my account.I call them and ask for it to be taken off and got told that it wasn't her fault that the money wasn't in my account, and perhaps i should check my finances properly :mad:

    The first thing you need to do is to open a spare bank account. Although most banks will not close your account (some have I know) it is fairly common to have your overdraft facilites withdrawn without notice. Therefore, it is crucial to have somewhere safe to have your salary paid into. Then, if your overdraft is called in, you will be able to come to a repayment arrangement that will still allow you to feed the new baby (congratulations).

    If your refund is paid to you before you commence court proceedings (quite unusual) it can be paid into your account which may be wipe out the overdraft and leave some spare. You won't know until you get your statements. However, if it is not repaid until you commence court proceedings then you can insist on payment by cheque.

    Incidentally, if the unlawful charges on your account have caused you to have a default placed on your credit record, you can insist that this be removed. I believe there is a form letter to ask for this on Consumer Corner. If not, ask Shaun and he will write one for you, he's really helpful.

    Just received letter from halifax settling my mortgage fee claim for £880.61 before it goes to court. There was a previous offer from Halifax CS for £330 which I refused and a confused defence for charges incurred on a previously closed bank account. They have now said to resubmit their defence would mean increased costs which they are not prepared to incurr. Therefore I have won...... do I need to inform moneyclaim ? how will I fair re charges in the future, should they not impose, is there a letter to send Halifax re any future charges?

  • Hi to everyone, been reading the site for months but couldent join in just got broadband at home so here goes, I am up to the money claim stage against yorkshire bank for just under 5 thousand I have recently been sent from England to Wales with my job can I ask for the hearing to to be in Newport or has it got to be near my address, also because of the hold up getting broadband I dont know if I can still claim or is there a time limit, please help thank you all in advance this is a brill site

    Hi everyone

    I asked this the other day but I don't think I explained it too well and it got a bit lost amongst all the other messages.

    I've sent the first letter asking for the charges back. The Halifax weren't due to reply until the end of next week but to my complete surprise, they replied two days ago!

    I'm claiming on two accounts (both in my name, one held jointly with husband). On the first account we're claiming £689 and the other £130. They've offered £366 and £100.

    The precedent letter on CAG reads as if I've already sent the letter before action which I haven't done yet - not reached that stage. Now do I send that letter, removing the parts about dates of letter before action etc? I must have to include some sort of deadline date in there. Do I incorporate the letter before action into this letter, giving a 14 day deadline?

    Please would someone in the know advise me on this - I'm not sure what to do now. I'm well aware of 'fine lines' in the legal world and I don't want to mess up! :eek:

    Dear [named sender or Sirs]

    Thank you for your letter dated xx/xx/xx
    I respectfully decline your offer of settlement and request, once again, that you return to me all charges imposed on this account, totalling £xxxx

    I will accept the sum offered only as part settlement and on the clear understanding that I will pursue recovery of the remainder, with a County Court claim if necessary.

    My letter before action sent previously indicates that you have until xx/xx/xx to respond before Court action commences. You are reminded that there will be no extension to this timescale.

    I trust this clarifies my position.

    So if yes, take out the bit in italics and add your own bit about what you will now do and give a deadline :)

    just interested to know how many people on this forum have had the bank file a defence as i am getting a bit nervous that i seem the only one i have seen in the last 2-3 months?

    Yes, its you giving them time deadlines and I would think you could go with which ever court you want as if it came down to it, its you who would have to attend. Not that I think it will come to that :)
