I've also been following this thread and am really intrigued (and horrified!) by the blame game.
I think that the technicality of having given your OH your pin is according to contract a wrong move but I have given my OH my card and pin before and would do again. I'd love to see this tested in court; could someone who you trust with your life, your children and all your most personal details with whom you have entered into a long and stable relationship (marriage or not) really be considered in the same way as a friend, colleague, or carer etc even if you have known that person for a few years?
On the issue of the faulty machine I can't see the reason why it should be such a problem. The machine is a computer driven delivery system. Every action is logged and as max2009 says most (perhaps all?) record video. If anything at any point fails then it will be noted in the log.
If the ATM was in a non-bank location eg petrol station, supermarket etc then the passing of the blame could be expected to a degree especially if it is one of those profiteering machines in a pub or similar. In this case once you had informed Abby and Halifax it is (IMHO) for Abbey to verify the recording/log and either cough up directly or to liaise with Halifax and have them refund you.
After Abbey and Halifax have verified that what you have told them is true then they (Abbey) should at least offer some compensation as it is entirely a failure of an element of their service which caused you not only inconveniece but additional expense.
Please do let us know how you get on i.e. how long they took and what if any compensation they offered?

This happened to me last year although my problem was that I had 2 cards with the same PIN (I have one PIN for all my cards) and I took the money out of one, put that and the card in my pocket then put card 2 in, machine gave me my card back which I then put in my pocket with the other card and cash then the machine came up with message - "sorry unable to dispense".
Problem was I didn't know which card had paid aout and which hadn't as I never get receipts.
I got the form from the bank the next day, as it wasn't their machine they had to send it off to the other bank - apparently a 10 day response time is given.
I filled gthe form out and sent in a covering statement explaining why I wasn't sure which account the money came out of
It took over 30 days to get the money back but do you know what the silly b*ggers did?
They refunded the money to both accounts :T :T :T
I haven't reported this to them - surprise surprise - the banks have helped themselves to enough of my money over the years.
During the 30 days I was waiting I did make plans if they didn't pay up, it involved visiting a branch after purchasing (and prising open slightly) a large tin of white gloss paint and tripping over my pushchair on their nice polished wooden floor - purely accidental of course - never needed to do that tho.

For all the people that are saying the OP shouldn't have given her OH her pin number...can you explain to me how a blind person gets their pin? I'll tell you how, somebody reads it to them. So if this happened to my mum (like it did but i'll get to that in a minute) they could NEVER say to her, well we're not giving it back because you gave your pin to somebody else so I doubt very much they would ever throw that in somebodys face. Could you imagine if they did and the press found out??
Like I said, something similar happened to my mum, we tried to take £100 out of her A&L account using an RBS cash machine, it was taking forever then just spat the card out, we did it again, did the same thing, again and it finally gave her the money. When she checked her balance the next day, they'd taken £300 out. It took my mum weeks to get it back. Luckily she had savings to cover it or she would have been in a very bad position. And it was A&L who were responsible for refunding the money, not RBS
I think it's disgraceful that we are expected to be without our money because the banks machines are faulty. I appreciate the banks have to check the machines but that doesn't take 28 days? It should be refunded within 48 hours.
Make sure you get as much compensation from both banks as possible.:heart: Think happy & you'll be happy :heart:

Re the issue of the pin, of course banks have to have something in black and white over this, however in reality I do believe many of them exercise common sense.
Years ago when my DD (15) went on an organised trip touring Europe I gave her my card and pin in case of an emergency. (They were responsible for their own meals). The bank were aware and kindly moved the SOs on it for that month so there was a fixed and guaranteed amount over the 2 weeks she was away. OH has the pin too as it is a joint account.
I imagine the problem with that would arise over the definition of 'OH'. Married? Children/mortgage? Transient lover? How long have you banked with them? In our case, we ticked the boxes so they made the decision.0 -
Can you not ask the bank for a temporary overdraft facility untill this matter is sorted ? Not sure if they can allow it on a Halifax/Easycash/Electron account though they are a bit Crap,I have one and as of 01/03/09 you cannot use the counter service just the machines this was OK but now if I pay in cash the machine takes 3 days to enter my account (Complete Mikey Take) good luck!!OH THE JOYS OF BEING SELF-EMPLOYED!! This happened to me years ago.
My OH was going to work and took my card as he was going to get some shopping on way home and I had a sick baby at home, when he rang to tell me what happened (cash flap not opening) I never for a moment doubted him.
I rang bank who basicly told me I wasnt getting my money back (£60 it was) and that my OH had clearly stolen it, was such rubbish we share money and there would be no need to steal any from each other.
About 4 weeks or so later I got a letter from Halifax telling me Natwest (I think it was Natwest anyway) had found my money and it would be returned to me, 3 working days later.0 -
I would go for the police as well, because clearly this is a theft and the Bank are responsible, and the Police have failed to investigate this matter. Then I would get my MP involved as well, because clearly this matter needs to be debated in Parliament on an early day motion.Make sure you get as much compensation from both banks as possible.
Oh, and just the other day, Girl in front of me at Cash Point left her money behind, and she was busy with Braticus Primera. I whistled and she came back for it with a smile! Perhaps I should sue her for the distress I suffered because I could had ...0
