    My wife and I are going the way end of april. Will phone the court this week to get a date.
    I am shure I need to come back for some advice.

    Thanks Don for the invite to the Inn, will certainly pop round... Received my CO-OP request for photocopied passport today, will send back tomorrow. Have not yet started to fill in BRforms and am worrying about creditors noticing that I have not paid them...
    So far all is still quiet!

    Hi bluebird,

    Your creditors obviously will notice but try not to get upset at any letters or calls you start to get from them. It is all about them using tactics to get you to contact them and pay. But if you are going BR, there is no point in throwing good money after bad in paying your creditors. I changed my phone number to stop the phonecalls which is something to consider if it will make you stressed, they will call several times a day from different companies, so your phone could never stop ringing.

    Long may the quiet continue however! ;)

    Do you think they could call me at work?That would be really bad! I think I may take the batteries out of my phone.... If I confirm who I am when they call, what can happen?I mean does this make it easier for them to take me to court? Thanks for your reply:)

    Yes if they have your work number they can call there but you can write a letter revoking the permission for them to use that number. And if they do call, tell them that you cannot take personal calls and to remove the number.

    best thing to do if they do call, don't confirm who you are, don't answer security - then if they continue to discuss it, they are in breach of the data protection act which is a big issue.

    It will take a few months for it to get to court stages - they will just send letters for a few months and then you would actually get letters from court if they did take it that far which if you have not gone BR by then, you could contact the court to discuss it. But you will be BR before they can take this action.

    Take further note that continued telephone calls after the receipt of a request not to call may constitute a criminal offence under Section 127 of the Communications Act 2003.
    You will be deemed to have been served notice of my request and I will deem it served by FULL DATE, I am advising you that any calls received after this date will be recorded with the intention of them being used as evidence.

    :confused: Thank you Donna! If they do take me to court does that mean I would have a criminal record? Sorry if there is an obvious answer but I haven't had my CAB meeting yet! Again many thanks to you, Dalip and everyone on this forum. I think without you I would loose my mind at the moment....

    There would be no criminal record so do not worry about that at all. No debtors prisons these days except perhaps in our own heads!
