    If the banks were to successfully appeal to the house of lords, i call for all bank charge claims to be quadrupled, lets fine the banks and see how they like it. We are only trying to claim back part of what has already been taken from us, unlike the banks who seem to quadruple what they are owed. Everyone should give serious consideration to sue for the amount of stress this has caused too. These banks have shown their true colours, no-good dirty time-wasting scum bags, they deserve to be driven into the ground for their deception of the good british people.

    Driving banks into the ground is a little counter-productive isn't it? Have you seen what happens when financial institutions lose their stability?

    And penalising banks in civil law is a little hypocritical given that the basis of the claim is that the charges are unlawful penalties.

  • Same here!! I phoned last wednesday, got my letter today stating they wont give me back £324 even though my OH has lost a quarter of his wages and i am unable to work. Anyone know what to do now?? My bloods boiling. I applied under the hardship ruling and i am also on benefits. I mentioned that i was told it was illegal to take charges out of a state benefit ( i get Incapacity benefit, child benefit and CTC ) and they said that once it has hit my account it is no longer considered a 'benefit' or state money?????

    I'm pretty sure that's wrong - maybe put this up in a separate post so that people can advise? It sounds really incorrect to me - that money is your benefit money, end of.

    Personally i dont have a problem with being find for being overdrawn, i understand that being overdrawn may cost a bank money. But it's the size of the fines that i have a problem with, they are completely disproportional. There must be some reasonable banks out there surely? which charge fair amounts (i wouldn't mind paying for any expense the bank incurred) but the fact that they have turned this into a major money making exercise and bonus builder for themselves makes me sick), if anyone finds one please let me know. i wanna sign up with a decent, honest and honorable company which puts it's customers first.

    Well, I've had enough of the phone calls, I called the ombudsman peiople who said they will look into my claim- not getting my hopes up, but would welcome the relief from the 08457 phone bills! Has anyone had any luck with the Ombudsman people in regards to being in financial hardship and claiming back their charges? they seemed to think it was an independant rule to the ones going through the courts at the moment.

    Cannot get my head around the fact they are in such "dire straights" yet still paying pensions and etc in money that would feed a small 3rd world country for years (possibly decades), then they seem to think its ok to claim all the charges...I really hope karma applies in this situation!

    though as we (taxpapyers) own majority of several banks, it may cost more / take longer for the various bailouts to be repaid..

    as for end of free banking- the first one to do this will see a lot of their account holders take ALL funds out, causing shares go into freefall..?

    Being charged to look after OUR money is just taking the pee.

    They've had it (depositers money) cheap for ages, charge a fortunme for even small overdrafts, but still can't stay in profit because of greed overriding good sense.

    The govt / FSA / BoE have FAILED us. neverr mind losing an early pension, messr bankers- pack your bag, and get ready for some jail time!

    This is my thread.I agree though, its still state derived benefit. I am having to get financial help from family just to make ends meet, so £324 would help in a big way. Plus at the end of all this i will still have to repay the money i have borrowed from the family.

    I couldn't agree with you more - if I mismanage my account (which unfortunately I did for a long time) it's my bad, I should be liable for what it cost the bank. Which is quite clearly not £40.

    Stop all bank bonuses (how can a company pay bonuses when it made a massive loss? This concept is completely beyond me!) and use that money to pay back what they have stolen from people over the years.

    They want to be bailed out by the taxpayer? Fair enough, I don't want the banking system to collapse, that benefits noone. But there has to be some serious improvement in the level of regulation coming out of this. Banks NEED to be responsible. Paying obscene bonuses and taking advantage of people who are vulnerable and on low incomes MUST STOP NOW.

    Lets hope the HoL give this further attempt at appeal the short shrift it deserves. This has dragged on long enough.
