With a bit of luck the banks may look more favourably at hardship cases. I hope so anyway as I'm going to contact Barclays.
Hope you get on better then I did with Halifax..called them 15 minutes ago, the answer was "we believe the charges are fair and are not refunding any charges). I have lost my job, I have 3 charges for a total spend of under £20 all on the same day, and an additional fee so in total £133. Fair?0 -
The banks can still choose to appeal directly to the House of Lords. The FSA’s hold on reclaiming is likely to remain in place, until the House of Lords has seen or rejected an appeal from the banks.
The BBA have already indicated they will appeal directly to the HoL. I have to echo some of the other sentiments I've seen, that enough is enough.
The banks have appealed and lost in both the High and Appeal courts. The judges made the decision unanimously and refused further appeal. They recommended the issues should now be resolved by an OFT assessment of fairness and went as far as saying appealing more is 'not the appropriate way to go forward.'
However, although they still have the right to appeal, this is simply a method of wasting more time. I find it difficult to believe their legal teams hold any hope of the Lords siding with them.
The progress has already been slow. It's taken too long to get to this point where the OFT can decide if the charges are fair. I hope when finally the OFT do get to look this, the banks are shown no mercy, as they have shown little to their customers in financial trouble from incurring charges.0 -
Whatever happens i think banks are going to have to change the way they do business. They have lent irresponsibly and used customers as a cash cow.
Now that customers are fighting back the banks will try to stop money haemorrhaging out.
I feel that the banks should not be giving out bonuses to any department that does not make a profit, that would mean that possibly some staff could have a bonus even if the bank makes a loss.
One final point a big THANK YOU to all at MSE towers for your hard work, you have helped many hundreds of people save money and I am sure saved a few from making major financial mistakes.

If the banks were to successfully appeal to the house of lords, i call for all bank charge claims to be quadrupled, lets fine the banks and see how they like it. We are only trying to claim back part of what has already been taken from us, unlike the banks who seem to quadruple what they are owed. Everyone should give serious consideration to sue for the amount of stress this has caused too. These banks have shown their true colours, no-good dirty time-wasting scum bags, they deserve to be driven into the ground for their deception of the good british people.0 -

Same here!! I phoned last wednesday, got my letter today stating they wont give me back £324 even though my OH has lost a quarter of his wages and i am unable to work. Anyone know what to do now?? My bloods boiling. I applied under the hardship ruling and i am also on benefits. I mentioned that i was told it was illegal to take charges out of a state benefit ( i get Incapacity benefit, child benefit and CTC ) and they said that once it has hit my account it is no longer considered a 'benefit' or state money?????
Incidentally, i'm with the halifax. Need i say more?:mad:0 -
10 Weeks ago i contacted Abbey to ask for my remaining bank charges.( i received £440, but still have £700 to collect)
As i am disabled and on benefits i asked for the remaining money ie; hardship.
I received a form to fill in ,and was told its in the hands off the ombudsman.
As i did not hear from them after 4 weeks i sent a letter to ask what was happening. To this day i still have not had a reply. I really think that the banks, ombudsman are working together, to make it as difficult as possible to get back any monies that are owed!
I hope that the news today that the banks have lost will get there backsides of the seats and get to work to release all the monies that they have taken!

When this is resolved will we then be able to claim back all the further charges incurred since 2007? I was already overdrawn when my claim was put on hold and was incurring charges monthly as I could not afford to pay it off at the time.0

I think you will have to put another claim in for that. Or if the bank are understanding ( doubtful) you could ask for them to add your charges on since the claim has been put on hold. If they dont, then my guess is you will have to do a fresh claim for those. Be very careful what you sign, as 1 friend of mine signed a statement to say she would never reclaim from the bank again........ & she is now trying to fight that said letter but to no avail.0 -

A bank is asking that I pay back about 100 pounds in unauthorised overdraft charges (currently 100 pounds overdrawn due to charges). Should I pay them back and reclaim the charges? Or should I ask them to clear the charges after this news, saving all the hassle? (assuming the OFT decides charges are unfair.)0 -

It is my understanding that you will have to claim.
They have dug their heels in and won't budge until told so.0
