Wrongly Accused Shoplifting In Tesco - Help

    Ok .....this is your reply after 40 (FORTY) posts....so you are obviously struggling with what everyone(?) is telling you...so I'll try and break it down....I haven't changed your post in any way...just put numbers in as markers, for reference....

    1) they politely asked if they could look in your bag
    2) Here is the reason for you: a customer had seen me putting something into my bag in the store.
    3) From your refusal to cooperate with a simple request to prove that you did not have anything still belonging to the store, they probably will have thought you were a shoplifter, but they were too professional to say it, because otherwise you would be claiming that your rights had been violated by a slanderous act
    4) refer back to number 2 (and 3 as well if you like)
    5) Well....you've questioned it....hopefully you'll take some of it on board
    6) your shopping experiences would be much quicker, and everyone else's time and effort wouldn't be wasted by such a trivial matter
    7) of course they could, it would, however take more time and effort, and it still wouldn't prove anything since a customer had seen me putting something into my bag in the store.

    You were seen stuffing things in your bag, so are bound to be suspected.

    I had a similar problem in boots yesterday, and was enjoying being followed around by the 'undercover' security, until they spotted a 'real' thief and all hell broke lose as they wrestled him away.

    I should imagine they have every right to ask to see your receipt. How many people buy 20+ of the same item and then return?

    This is not quite correct, the security guard has no power to detain or arrest beyond what any private citizen has. And citizens cannot make an arrest on suspicion of an offence having been committed. If the OP had decided to leave the store in this case and the security had used force to detain him it would have been unlawful, and a number of offences would have been committed against the OP.

    For a citizens arrest to be lawful, the citizen needs to know that an arrestable offence has definitely been committed before making the arrest, only a constable can arrest on suspicion of an offence having been committed.

    But I do agree the OP was stupid in the way they acted, there was no need to turn a simple request into a huge incident.

    Oh dear, some people would rather be unhappy than wrong. I'd certainly be unhappy if the police cautioned me as I think that would plonk me straight on their naughty people database. Hardly worth it just to feel righteous.

    OP should get a £50 voucher for the distress, I mean a store like tesco should have better trained security people who should be able to tell a REAL shop lifter from someone like the OP. I mean just cause they were seen putting stuff in a bag hardly makes them a shop lifter, security should be aware of all transactions that take place and customers who then re-enter the store after 1st purchase.
