    in reply to martins post, ive been sent LOADS of spam like email from cdwow and got no voucher, not even 'you're not eligible' type email. ditto the OH who has nothing but spam to show for cd wow's offer.

    Just to say well done to heyho for getting a voucher - would have been a shame if you had missed out - got there in the end! :T

    I wouldn't agree with that Martin, I'm afraid. If you have applied (genuinely!!) and retained the CD WOW response which states that you will get the voucher, as I suggested right at the start of the thread, they have indeed entered into a binding contract.

    I also think that there is a generally accepted definition of what a "reader" of any publication is - this is why the circulation figures of any journal usually show two figures - the numbers sold and the actual (normally larger) readership number.

    CD WOW have also undermined their case by changing the T&Cs after the event. As we have seen the proviso to "subscribe to the mailing list" was not on the original T&Cs but was inserted at a later date, arguably to dissuade some applicants from pursuing the case. That behaviour seriously undermines any "argument" they may have.

    I may be wrong, but I still believe that Trading Standards ought to be the best route forwards for disgruntled genuine applicants.

    personally (and this might just be me!!) i always think of things like this as 'bonuses' not rights, and when things dont go my way, ie tescos dont take coupons for things i didnt buy, or the SA wont scan certain vouchers at boots, i dont think of it as my 'right' to claim certain things.

    yes ive written my fair share of complaining letters/emails expressing my disappointment. but never demanding goodies. and often this works. my attitude has always been freebies/special offers are bonuses, not rights, so dont expect them to always work out.

    ive accepted my 3x £3 vouchers grudgingly. its not what i hoped for from the promotion, but its better than nothing!

    All I can say is if your unhappy email time out and they will be more than happy to look into your case if you are a genuine reader or think that you can get away with it.

    I have had a few emails from time out and they are unhappy that CD WOW changed the terms and conditions that you needed to be on the mailing list which is NOT that case.
