Big sigh of relief - OH got the job he went for yesterday!!! :j
Another pay cut, and it's a trial period, but it will see us over christmas and past the tribunal, then we can take stock after that.
So he finishes at the current place on Fri, and starts at the new place on Mon. I'm quite proud of him, that's not bad going for during this 'economic climate'
And so the story continues....:o:rotfl:

Oh we will!!!
Our solicitor is going to draw it up when she arranges our next meeting.
She hasn't even met OH yet - I travelled through and laid the ground work because his (soon to be ex) boss wouldn't give him time off.
Incidentally, we do believe it was the tribunal looming that lost him his job - he asked to use some of his accrued holidays to attend it, the very next day the boss said he had to let him go.Learn from yesterday, live for today, hope for tomorrow. :cheesy:0 -
Yes, I think I lost a job (which I had been offered in writing, subject to refs) because I mentioned a tribunal. Learning point - don't. I hate lying, but I think it might be essential in this case. (Employers HAVE to give time off for emergencies involving dependents, although to be fair it doesn't have to be paid

Just wanted to say how amazing I think you and your OH are for pursuing the tribunal. Not everyone would have the determination to follow this through and you have been the recipient of some truly bad luck, so fingers crossed 2010 will bring you better times and a big smug grin win you win the tribunal.0

^^Thank you
Saw the solicitor again last week (been busy!!) she informed us that the Respondent's solicitor had phoned her and said that they will be pursuing us for costs if they win they case.
She did say that it is a very slim chance they would ever be awarded that, but she had to inform the insurance company, as they (obviously) want to be informed of all the positives and negatives of the case.
Anyway, she filed a report and the outcome is that the insurance has raised their cover from 3k to 7k due to the complexity of the case :j
Oh....and she did ask if I wanted to go and work for the company because she was impressed with the work on the bundle I handed over to her lol. :rotfl::rotfl::rotfl:Learn from yesterday, live for today, hope for tomorrow. :cheesy:0 -
It is usual practice to try & scare you a bit more by threatening you about costs.
It's been a tough year for you, hope that you enjoy a relaxing Christmas & look forward to hearing a positive conclusion to this in 2010.
Merry Christmas.0 -
Good luck Amber, don't let them grind you and your OH down. Hope you both have a lovely christmas and stick it to them in the new year!0

I take my hat off to you both, Amber. Lots of people would have thrown in the towel ages ago, faced with your situation. I can't offer any legal advice, but would like to wish you and your husband the very best for next year. I will be watching this thread with great interest....0

Hello, me again
Hope you all had a good Christmas, and that Santa was good to you
We were working on the tribunal right up to Christmas Eve, and again during this week.
OH's Solicitor found it strange regarding the employees who have 'supplied' statements about bullying...... none of them are on the witness list for the other sideso she has got a summons from the tribunal for the lot of them.
After all, OH has asked numerous times for incidences , dates and times of the alleged bullying incidents but none have ever been supplied. The guy I spoke to earlier this year is still happy to go and still says his statement was amended.
Another thing - apparently she has had the Respondent's solicitor on the phone again looking for OH's current employment contract. Well, he doesn't have one as he is working week to week and we don't know if he will be kept on after the new year. Anyway, our solicitor thinks they are going to argue (if they lose) that since OH got a job 8 weeks after being sacked, they had no financial responsibility after that point, as it was his choice to take on a much lower paid job.
I am hunting for all the records we kept showing the 30-40 jobs he DID apply for to prove he had no option but to take on a lower paid position. Bloody cheek of them!!!
On the other hand...it does sort of show that they are thinking 'how can we save money if we lose' instead of the arrogance they have shown this far assuming that OH doesn't have a hope......:)
This is the last I am going to think of this for this year - so I hope you all have a Happy New Year and all the best for 2010 to you all
