Advice about dismissal - please

  • Are you saying OP that your husband has done NOTHING wrong at all? I find it hard to believe that a company would dismiss someone without good reason and for a serious offence. Although I have only worked for large organisations, how many people does your husband's former employer have on their books?

    unfortunately, companies dismiss people all the time because they think it is the cheapest way to do it, they don't know what they are doing or anything about employment law, they think they can get away with it, that staff won't complain etc etc

    i have seen this happen at least twice to people i know

    A manager came back after long term sick leave, meaning there was one too many managers. The other manager had been with the company since the start (and was on 2.5k less wages) OH was the newest.

    The company has around 100 employees. They have a habit of just getting rid of people when their face doesn't fit. No -one stands up to them, which is why they keep getting away with it.

    OH was told by the directors that his centre better be up to scratch as once before the owner wasn't happy with a certain place, so he got rid of them all(!) unfortunately when OH passed this info onto his staff he was acused of threatening people they were going to lose their jobs. Go figure :rolleyes:

    My advice for your husband is try and get a job within a fairly large organisation, there is less chance of this sort of thing happening. And often their is TU recognition too. I hope things work out OK.

    Well OH's colleague has written him a reference to use for job hunting, so that may well help a bit

    We have also been sent all the evidence from the company with regards to statements and copues of the disciplinary. I haven't been through the statements yet, I have a zillion other things to cope with at the moment.:o

    But, on the up side, he shocked the woman at the jobcentre when he signed on for the first time on Friday - he produced 3 A4 pages detailing his job search, and the two jobs that flagged up as suitable for him on her comp - he had already applied for them :rotfl: She said there was nothing else she could do to help him.

    He has 2 interviews tomorrow - one is with a company he has worked for previously, with no problems, so we are partcularly hopeful about that one.

    Just keeping fingers crossed now

    Hi - not been about, have had a few net probs.

    Interviews were a no-go. The first one, the guy seemed a bit dodgy, and OH wasn;t too happy with the situation. The second one, which we had high hopes for - the guy who was leaving withdrew his resignation 1 HOUR before OH's interview :mad:

    They are going to contact him if anything else comes up.

    Have heard about the appeal though - it is going to be this Thursday at 10am.

    Something I wanted to ask if anyone can help. After OH got the witness statements last week, the other day a new statement came through backing up the other ones. It was from another employee and it states:

    'I have been asked about the allegations of bullying which have been made against the former manager, Mr **** which led to his recent dismissal for Gross Misconduct. I have been shown copies of the witness statements made by ****, **** and *** and also a copy of the notes taken at the disciplinary hearing conducted by Operations manager ****. I can confirm that the allegations made against **** are factual and true'

    etc etc

    What I am wondering is...should he have been allowed to read all the statements and meeting notes before making his personal witness statement? :confused::confused::confused::confused:

    OH has had the impression that this guy was put in there to report back to one of the directors and his statement has now confirmed this. OH has contacted the guy who was transferred out to put this 'spy' there, and he has said he will provide a statement to back up OH cos he thinks this guy and the director are just out to get OH. OH kind of let it slip that the new guy is on 4k a year more for doing the same job...oops :o

    OH is pretty much stuffed tbh, they have done a total number on him.

    He is so angry at it all, he knows there is no chance of getting his job back, he just wants his name cleared now. As he says, if he just accepts it and goes away quietly, people will believe all these nasty accusations are true.

    This statement that you have recently received seperately, was this part of the original evidence used for the dismissal? is it dated after the dismissal. If it is my personal opinion is that it is not admissible and should have no bearing on your OHs' appeal hearing. I would also have thought, again my own opinion, that they have again shot themselves in the foot by trying this tactic.

    I would still go for the jugular and let them know what many have said so far that they have not followed the correct procedures and make it quite clear that this statement does not have any bearing upon OHs' appeal as it was not part of the original evidence used for his dismissal.
    I would also think that as this person was supposed to be a witness then for him to be shown these statements was totally wrong.
    Be strong and don't let them get away with this.
