Digimate DGM 32" LCDTV 'Out of Warranty' [RESOLVED]

Update 4th March 2009: The television has been fixed and returned.

I don't know if this is the right place, but I have a serious complaint about Digimate (DGM).

I purchased a Digimate 32" LCD TV from Scan Computers (www.scan.co.uk) on 12/12/2006. It took ages to arrive due to their 'Christmas Delays' and when I finally got it, opened the box to find all the manuals and a sheet of plastic with details of registering to get 3 years warranty; so of course like a shot I registered with Digimate and job was done.

Christmas 2008, the television decided it had had enough and conked out. Now I get just a lovely blinking orange/red light. So off to Digimate to claim on the warranty; only to be told that they only give out 12 month warranties and the person I spoke to had never heard of the 3 year warranty or even the plastic sheet included in the box stating 3 years warranty upon registration. I even took a scan and a photograph of the sheet, but it was not good enough, 12 months warranty, you're out of luck !!!!!! off!

I even contacted Scan Computers to see if there was anything they could do for me, but they we're unable/unwilling to push it hard enough to get it repaired for me.

I would seem that the television I purchased was held in stock for some time, which DID come with a 3 year warranty; but this changed (conveniently) on the 12/12/06; same day I purchased mine. So am I completely out of luck, do I have any leg to stand on, or is it simply a journey to the local tip?

Has anyone else had this problem?

    Did scan advertise it with a 3 year warranty?

    Also did the piece of paper say that the 3 year warranty was only valid until 12/12/06?

    Did you pay by credit card?

    If scan advertised it as having 3 years warranty then as your contract is with them you can hold them liable.

    Even if it didn't you can argue that the goods are not of satisfactory quality as its gone wrong after just 2 years and therfore scan should pay for it to be repaired.

    If you paid by credit card you can compalin to them.
  • I can't honestly remember if it was advertised as 12 or 36 months on the Scan website, but I was shocked to see the 3 year warranty in the box, so I jumped at it. On the plastic sheet it states (in numerous languages) 'Register within 14 days to get 3 years warranty on your DGM product', but there is no 'expiry' date printed.

    When I phoned Scan, they seemed less than interested in helping, or even suggesting a resolution; just pretty much hard luck now !!!!!! off.

    I think I shall call Scan again, and maybe push abit harder, maybe I was TOO nice when I spoke to them the first time round. DGM or Repairtech are a complete waste of space.

    I could call my credit card company; though they do like to drag their heels alot; I'm still waiting for something to happen about some glasses I purchased online but never recieved; but that's another story.

    So, plan of action:
    1. Call Scan and state that I am not satisfied that a product has only worked for approx 2 years and it is of unacceptable quality.
    2. Call my credit card company and tell them the what's happened; either requesting a refund or to claim for the cost of the repairs.

    Would that be about right?

    I thought about that; I've had a quick look around but I can't find any contact details for who I need so speak to. Is there a national contact which I can use or are they local offices? I live in Dorset.

  • Trading Standards don't take calls directly now, call Consumer Direct on 08454 04 05 06 and you can get advice and log a case with them.

    What they will prob (should!) tell you is that Scan are the legally responsible ones so regardless of any warranty (12m, 3y or nothing at all) Scan should be doing more for you than they are, repair, replacement, partial refund etc.

    Also to note, any warranties / guarantees given out after April 2003 are legally enforceable, so you could argue that the terms of your warranty was 3 years as that is the info you had and signed up to at the time, doesn't really matter if that is normal for DGM or not, you're not suppose to know the ins and outs of their warranties, just the relevant one to you at the time.

    Run all this by CD and hopefully you'll get somewhere.

A good indicator of an itme being faulty is that it has broken down earlier than it would reasonably be expected to. Your next step is to remind Scan of this and if that gets you nowhere you take them to the small claims court through the link Zandoni provides.

  • Okay, I'm trying to write an email to Scan; which I shall send and follow up with a phonecall... So far I have:
    It has been brought to my attention that under The Sale of Goods Act the Retailer (Scan Computers) has a legal duty to repair a faulty product for up to 6 years after purchase.

    The product in question which was purchased 12/12/2006, has broken down earlier than it would reasonably be expected to (approx 2 years) which would indicate
    the product was not of satisfactory quality.
    I know that there should be something at the end, but I'm now stumped to how to finish the email. Please let me know if what I have got so far is totally not acceptable.

    Any ideas of a template email would be greatly appreciated.
