I have a 5 month old fridge/freezer from comet that has broken down. Comet have sent a repair man who said it needed a certain part which was out of stock. A week later another repair man came and said it now needed a new motor, which he would have to order.
Basically we are going to be at least 3 weeks without a fridge/freezer which is not good as we have a 6 month old baby as well as a toddler. Comet say they do not offer replacements and we are just unlucky!!
Do i have the right to a replacement ?0 -
Hi, hope someone can give me a bit of advice here. My dad bought a washing machine 3 months ago, it stopped working on friday and engineer came out yesterday. He couldnt repair it on the spot as he needed a part, and is coming back on friday. My dads partner isnt very happy, I dont blame her, she says she wants a new machine, not a repaired one. What rights do they have? If they get it repaired then something else goes wrong, where do they stand. 3 months isnt a long time to have a washing machine, break down on you, she feels that this is maybe a faulty model or something, I'm unsure of make/model and cant contact him at the moment.

Sue, I think you have to give the store the opportunity to fix it. You cant demand a new one just because it broke down so soon.
If it breaks down again and again, you should be able to get the store to replace it.
When something is inheritantly faulty, the burden of proof lies with the retailer within the 6months to prove otherwise. i.e, they have to prove it's not faulty.

Don't forget the Distance Selling Regulations could apply to goods that are not purchased from a store.

I bought an XBOX 360 game last week from an online retailer. It was in pristine condition and worked fine...for 15 minutes.
After this time an error came up on screen saying the disk could not be read and to clean it. I removed the disk and there was marks all over the disk (were not there when I put it into the console).
I contacted Microsoft as the 360 console is known for being problematic. They stated they would not replace the disk as it is not published by MS but would take the console in for repair (free of charge).
The disk keeps stopping and is covered in marks. It was brand new and I don't know who is at fault.
I am at a bit of a cross-roads at the moment. Here is what I have done:
I spoke with Microsoft again and they have offered another game as compensation (lesser value and a lot older title).
They will be taking the console back for repair (free of charge). They are adament, however, that the console will not damage games which seems a contradiction seeing as they are taking it back for repair.
They keep telling me that I must have moved the console. The system is positioned in a static and secure area so it would have not moved. I am quite sure that I did not perform a tap dance on the system!
MS will not replace this game as it is not a Microsoft published game
I spoke with the publisher of the game and they will not take responsibility other than me paying £8.00 for it to be tested. I know this is not a lot of money but that is not the point. We only played it for 15 minutes and it became damaged!:mad:
I am not going to lie to the shop I bought it from, as it was in pristine condition when I opened the packet. I can get it working with a firm clean but I fear it is becoming more damaged as we use it.
As a consumer, and seeing as the game is only 5 days old, where do my rights lie?
One person is saying defective disk, the other is saying defective console!

Think you will have a lot of hassle and acceptance of Microsoft's offer to deal with the problem might be best unless you want to seek a refund.
Doubtful, in these circumstances you will be able to claim against the game supplier. Maybe you could ask the retailer to arrange a disc repair or provide a repair kit ( I don't know how effective these are)0 -

Hi all,
I purchased a LG plamsa tv approx 2 years ago from richer sounds. It is located in my games room (which seemed like a good idea at the time but in retrospect has been a complete waste of money - but it looks good), and if it has been on for more than 50 hours in total, I will eat my left arm and right leg.
It has now developed a fault - a vertical line has appeared on the left hand side of the screen, which is pathetic considering the usage the tv has had. I could understand if it would have had daily usage, but no this simply isn't the quality I expect from a veiwing device. It hasn't even had to work hard in its 50 hours - the occasional movie or background music - hardly demanding. They just don't make them like they used to.
Question is do I have a leg to stand on (left leg still in tact)? I've heard 5 years is a reasonable lifespan for a television, and if so, how do I go about it? I'm willing to take a lie detector test on the viewing time - hopefully it has its own 'black box' that can prove my innocence.
Any thoughts on how to proceed?

hi all !!!
i recentley brought a lap top from tescos three weeks later it broke. so i returned it with the receipt but the laptops were now reduced. so does anyone know if i should of got the new laptop at the new price!!! they are saying no. but other store where i food shop says yes as long as i have my receipt .. im now very confused. please help0
