    Hi Mega, sounds like a bit of a nightmare! :eek:

    If they truley didn't want to give a refund or exchange on TD items, I would have thought that Boots could have implemented a policy whereby if you did not have a receipt showing that you paid full price in the case of TD items, they would only swap within the range.

    I'd email Boots, the SA was rude and unpleasant, and I'm pretty sure that that sort of behaviour isn't in her job description. She could easily have referred her query to the manager without creating such a palaver. :rolleyes: The manager obviously had no real problem with what you wanted to do, so I can't see why this SA needed to behave like this towards you.

    I'd use Dave's list of complaints and forward an email immediately. At the very least it will register that you were not happy with your treatment, and will be passed onto the store manager for comment. At best you may get some extra points put on your card.

    Perhaps "CrabbySA" would like to comment on this, and the customer training that she has received! :rotfl:

    Doesn't mark fabrics and I think you will find doesn't bring on the prickly heat - at least that is my experience!

    You are right Dave, I'm a law student in Dundee, goods on display on the shelf are classified as an invitation to treat, but to make a valid contract there has to be two or more parties intending to be legally bound in some form of legal transaction usually involving goods, or services but not always in exchange for cash.

    An offer has to be made to one or more parties (customer to sales assistant for example) or to the world at large through an advertisment followed by an unconditional acceptance from the person(s) to whom the offer is addressed.

    In this case the offer was made to the sales assistant to buy the goods at the checkout, who accepted when she took payment without adding any further terms or conditions (unconditional acceptance as opposed to counter offer) making a valid and binding contract thus the goods are now the customers to do with as they please.

    In other words you dont need to leave the shop to rip off the voucher to use as the goods are already yours as a valid contract has been made. Sales assistant was just being pedantic / stubborn or shall we stay stupid / ignorant of the law?

    If she, the sales assistant wanted to be picky, its a different transaction to which you have the receipt for the original to prove a point, so if it does say "to be used on next purchase" you are indeed doing just this.

    If you use the voucher before purchase, by this i mean rip it off the product at the checkout, this can be deemed as theft as you have not made the original purchase / formed a legally binding contract to be the legal owner of the voucher to be able to use it.

    Although quiet, and this is my first post in this thread, i love reading it (got some ei had wash the other day, but never went over board 108 seemed a bit much even with 3 sons).

    do you ever read the tesco`s thread? i would be interested in what you have to say over there about their policy and r&r`ers being accused of fraudulent refunds! sorry to get off thread. :)
  • i havent got all the time that teh tescoers have, it takes AGES to find mispriced things i tried it once and well never again! :)

    I agree, but I do make sure that I check my receipt very closely now! But then I also check my Boots one closely to ensure that all my lovely points have been added.! :D

    I don't work for Boots and never have. I am a Boots customer, who likes you all, loves a bargain. However, I thought this forum was called 'Grabbit while you can'. Perhaps it should be renamed 'Grabbit in which ever way you can'. There seems to be so much dishonesty being discussed.
    For example:

    Taking things back with the intention of obtaining a refund of more than you paid.

    Knowingly breaking the terms and conditions of the AC vouchers.

    Trying to obtain the free gifts without making the proper purchases.

    IMO all the above is morally wrong, it saddens me to see how many people think it is acceptable and I sympathise with the Boots Staff.

    some things are dishonest and some things are cheeky. dishonest is nicking a full-size product, cheeky id taking a handful of free samples of that product. cheeky is using a AC voucher thats not in your name, cheeky is getting a no7 gift with your parenting club freebie no7 product.

    i admit im cheeky but im not dishonest, ive enevr nicked owt in my life and i never intend to (and that includes when i was homeless and had naff all coz they took months to give me any benefits!)
