Three wont return phone within 14 day cooling off period

My email seems to have bounced back from three i used: customer.services@three.co.uk but it doesnt work. Anyone know any others? I am hesitant to use their website as i cannot prove i have emailed them.

did they inform you beforehand that you could not return it if the phone was turned on?
did you inform them you wanted to return the phone within 7 or 14 days?
if it was within 7 working days tell them you want to return the phone under the distance selling regulations which by OFT definition "give consumers an unconditional right to cancel an order. This is to allow the consumer the opportunity to examine the goods or consider the nature of a service."
ask them how you are meant to examine the goods without turning the phone on? the functionality of the phone is more important than the physical look of the phone.

the only point they might be able to argue is, this exception:
(d) for the supply of audio or video recordings or computer software if they are unsealed by the consumer;Yes Your Dukeiness

In fact its a c905. Ive seen it on the orange network and it is good but when i received it - its far from what i expected! I will try that email now.

the c905 does do a 9hr battery life, i use one every day at work with no probs, BUT on 2g mode not 3g which is a bit useless on a 3g based networkYes Your Dukeiness

me again,surely three should honour your faulty phone as they should have a manufacturers guarentee/warranty for the first year?

you would have thought so but i said to them i want to return the phone and cancel due to the problems i have had. Looks like they probably want to lose me and so forcing me to stay? I have requested to be put back on to my old contract and they still wont do this.0

thats really unfair they are doing that,especially as you are within the 14 days. cant really offer any advice but i hope it works out in your favour

One of my mates was able to take back his used iPhone within the 14 day cooling off period. I don't know why Three wouldn't???
