Three wont return phone within 14 day cooling off period

I have just upgraded with 3 and the phone has poor reception, the battery life is poor. I only had the phone a few days and now 3 wont take the phone back - they say an 18 month rental cancellation fee applies.

Is this right? Can they stop me returning the phone if i cannot use it properly?

    Upgrade over the phone so i thought distance selling regulations stipulates u can return it. They argue since i tried the phone they wont.

    Yeah their is a DSR period if its taken out over phone/interwebs, Whats their argument for not returning?

    They argue ive turned the phone on so i cant return it. i.e. its been used.

    Furthermore, i feel the handset is faulty as my phone calls tend to drop when in call and the battery life is nowhere near the 9 hours (talk time) stated on the phone spec. However i have a feeling 3 will not accept this excuse and its not like i can prove it in court if i try to force them to take the phone back.

    What options do i have. If i do send the phone back to 3 then i have no proof its faulty and they will still charge me for the full 18months. If i don't send the phone back they will continue to charge me.

    Write a complaint, Dont worry, Complaints team are based in Glasgow, Scotland, Not in the middle of a desert

    I have done this. However, i want to make sure the 14 days dont run out. What is the legal stance on the issue regarding turning the phone on?

    My email seems to have bounced back from three i used: customer.services@three.co.uk but it doesnt work. Anyone know any others? I am hesitant to use their website as i cannot prove i have emailed them.

    SO... now England its the Scots turn to say dont leave the UK, stay in Europe with us in the UK, dont let the tories fool you like they did us with empty lies... You will be leaving the UK aswell as Europe ;)
