Have you seen the CCTV tape that. Has the person conducting these meetings seen the tape.
On the tape you would see the Manager putting the bag under the desk at closing time. Then when you came in it would show you working and sitting at the desk. It would then show your collegue coming in and you doing whatever. So long as the tape does not show you bending under the desk to pick up the bag and conceal it or leave the room I do not see how they can accuse you. It may actually show someone else picking up the bag between the time it was put there and the time you came in.
You really need to get them to show you the tape to be sure the money was put there in the first place. If you can prove it was never put there then you cannot be accused of stealing.

This stinks, deni. Going back to my earlier questions can you actually see the cash itself or does the boss say it in was in a bag/container of some sort? If all you can see on the CCTV is the container (the cash is supposed to be in) then all you can see is the container unless there is some sort of similar proof that there actually was money in it.

What was the boss's explanation for leaving the cash lying around?

This sounds so strange. How can this have got this far without them proving the money was there?
Have you been given the company procedure on money handling? Have they explained why it was under the desk, or possibly at your boss' home?

I would tell them you are seeking legal advice and then get it.

hiya update

iv done everything everyone has said and on thu evening i got arrested and charged on the grounds that apparently i was seen picking an orange object up....knowone knows what it is even i dont and put it in my bag so there we go im due in court in march had some advise but its not looking good for me but im not allowed to talk about it any further my life is over and i wont be able to get a job that i want ( either in care or management in retail/catering) i prob wont even be able to sign on CAB told me if your dismissed for gross missconduct sometimes you cant sign on for upto 6 months dont kow what im gonna do im only 25 never stolen in my life worked since i was 16 lead a honest life and feel like its all over

Hi Deni, do you have legal representation? It may be worth you contacting the Law Society in the Guildhall Market in Derby if not, you need to be strong and I understand how hard this is for you but we are all with you. Keep us posted.

yes iv seen the video i dont remember a orange item i cant even think what it could be at all they kept asking what colour my note book is ( something i was looking for) and asking if i have it but its green and still at work, i have a pink makeup bag that i get out my bag but thats it and its very pink
been on a downer all weekend thinking of going docs getting him to up my meds (on prozac 20mg at min) iv started ann summers partys with a friend to make extra cash on weekdns but i need a job the house me and my bf rent is 495 a month im in debt i'll have to get some bar job or something

I take it you have been charged with "theft"....in which case, how were you given a court date in March, I take it you were properly cautioned before giving your statement, did you employ the services of a solicitor...have you been in touch with a solicitor, who advised you not to discuss it further. I f the statements you have made so far are correct, you are unlikely to be convicted of theft...I really hope you have a solicitor.

Apparently picking up an object...that can't be identified...and no one knows what it is ... is not a strong enough case to get a conviction, for goodness sake, no one has been able to say the money was there, no one can place the money at the scene, the manager doesnt even know where the money was, she did after all wonder had she taken it home!!! so how can you take what wasn't there in the first place....perjury is a serious offence, I hope your manager realises this...your advising solicitor and barrister will make sure your manager knows.
