by my calculations you've paid it over 44 months - 44 x 150 = £6626.84 so they're not even paying you back what you've paid - you need to get back onto them and tell them you want every penny back + 8% statutory interest and the loan to be reduced by £150.61 for the remainder of the loan period - they're trying it on !!!

no to the underwriters which is lloyds of london - claiming an unfair contract term under the Unfair consumer contract terms regs 1999
  • thank you, I will write to them again tomorrow and put in the bit about taking to FOS if I am not satisfied with their response.

    I'll report back!

    Hi marshallka

I will write back to Central Finance as you suggest to say that I am not satisfied with their offer and that I am going to take it to FOS, but should I wait to hear back from Capital Finance or write to FOS at the same time?

Sorry for all the questions, this whole thing feels like a bit of a nightmare to try to work your way through!:o
It is your decision though but just my view on what i would do. ;) Entirely up to you though.

    Good luck

all you've got to lose is the price of the stamp - even if the fos can't look at the first loan you could still claim for a low rebate when you redeemed your loan early - this is with the underwriters for an unfair contract term
Or maybe the underwriter for the misselling. I know that FOS are actually accepting complaints against underwriters for misselling as some have posted on here.;)
