PPI Reclaiming Discussion part 4

    I mentioned yesterday that a store card I have turned down my PPI complaint. Well today same bank, diff store card has upheld my complaint. Exactly same complaint!

    Should I write back to the first person and query why they have applied different rationale to essentially the same complaint??

    Worth a shot I reckon...

    Maybe they realised they made a mistake and taken another look, but to make sure you do get this refund, I would contact/write to them just to make sure on this and also enclose "copies of the letters you received from them".;)

    Sorry confused the issue.

    I have 2 store cards with the same bank.

    Store Card 1: complaint rejected
    Store Card 2: complaint upheld.

    Yet, my reasons were exactly the same for both. Just seems like 2 diff case officers came to diff conclusions. Just wondering if worthwhile going back re Store Card 1 and saying how come you upheld 2nd card complaint but not this one.

    Hope that makes sense!

    I keep all my bank statements and I remember I had been paying PPI on my Lloyds TSB Credit card, but I never knew it was something I could cancel until a few years after taking out the policy.

    The statements date back to 1999 all had PPI until about 2006 when I realised I could cancel it.

    Although all my statements clearly say 'cardholder protection plan' do you think it will still be worthwhile claiming? I was aware I was paying it, just that I didn't know it could be cancelled. This is the same for a few other credit cards I had (I have all the statements).

    Also I have a loan from 2000 until 2003, which I paid payment protection insurance on - I remember the conversation in the bank and I was strongly persuaded to take out the insurance it felt like it wasn't an option to not take it - again do you think I could reclaim?

    was one taken out before 2005 and the other after

    oh yes, the selling of ppi became regulated in 2005, hence why one has been upheld - the later one and the other rejected because they think you can't take your complaint to the FOS
  • They have said I can complain to the FLA. Do you suggest I do this or go back and ask them to explain why the distinction between the two?

    yes you could do - but don't hold your breath and the FLA is about as much use as a chocolate fireguard, the Financial Ombudsman service has said that they may look at holding the underwriters of the insurance responsible - they've only decided this in the last month or so, so fill in the FOS form and send it off along with the final decision from the card holder- they'll probably need the name of the underwriter so if you can locate any policy documentation it would help - they'res not guarentees but at least it's a further step forward
