    Hi Portofino, even if you go back to them and ask for the distinction between the two I would say they would still say to you to make the complaint to the FLA with no explanation. The reason why they do this is that although they were most probably sold the same and both "missold" one of them is not under the jurisdiction of the FOS and I have only heard of one on here that has actually won via the FLA. If I were you I would go to the FLA and voice your concerns that they have actually only dismissed the complaint knowing that you would not be able to take it to FOS.

    I would still let the FLA know though your views and perhaps the FSA and OFT as well just for the record.

  • please adise re letter received to accept offer but refers to taking out new agreement to cover loan not fully paid but iva was set up to include this 2006 .Can they do this if we do not accept they will not pay money tyo us but they accept ppi was missold in their letter. What should we do .

    I have 3 PPI claims at the early stages with RBS, 2 relate to loans that have been paid off and 1 relates to a loan that I am paying installments on (CCJ). My question is if I am successful with these would I be entitled to receive the refunds for the ones that have been paid off, or would the refunds be paid to clear the loan that is still in arrears? Sorry if my question is slightly confusing, basically I just would like to know if I would get any money back if successful or would all 3 claims be paid back to the loan that is still outstanding.

    I note you mention about an IVA set up.
    I am aware they can do this, and anything remaining they should pay directly to you.

    Hi there

    Although this can vary from one bank to another, many do actually refund towards active accounts if there are any arrears, I think though you could write to argue these these are settled accounts (2 of them), where you expect to receive the refund paid directly to you, and maybe on the CCJ one refund towards that on and anything remaining to be paid directly to you.
    There is no harm in writing to request for this, but as stated banks vary from on to the other, they may even refund it all back to you, see what they come back with and take it from there first if you want to.

    can anyone help? im in an iva and claiming on three loans from years five years ago but none of these loans i am claiming for are in the iva as they have been paid off. if i was to win would the money be paid directly to me? sorry to keep bothering you.

    Yes I think you would be entitled to receive your money here, but hopefully someone will be able to confirm, wonder if posting on the IVA thread will be of some help to you there as well, I expect many have been in the same situation and have posted up on there, give it a go and see if anyone has some answer on this one for you good luck hun.
