    Thanks for that info I have now called fos and they were helpful and said more or less the same however they are sending me a form to sign and return (they will now take over) with a copy of final reponse from barclaycard and the lady at fos also said that they are receiving a lot of enquires about this and will try to help but no gtees ( even though she said some have been successful) so i will wait and see... keep you posted
    Also I have another claim with what used to be the woolwich loans obviously now barclays and they sent me a letter in the middle of nov saying they have passed to the retail banking, cust relations at barclays bank in wavertree technology park in liverpool but not heard a dicky!! and cant find a telephone number anywhere I have even tried calling woolwich that sent the letter but they say they dont have a contact number!!!! how ridiculous being the same company !!!

    I just finished my call with Empire Claims.

    They have just admitted ( though not actully saying so ) that they were trying to pull a fast one. I got my final bill down from £551 to £325.

    This is a result really, but please, anyone else dealing with Empire Claims please read all the paper work and amounts before paying up. They can be quite convinsing if you dont have your head screwed on.

    To any new claims, dont bother with them they are not worth the hassle,

  • Hi, I have a little question for all you knowledgeable folk...

    I put in a claim for mis-sold PPI for my sister at the end of November, the 8 week period was up during the christmas holidays when she received a letter from them stating that they need more time for their investigation and will contact her again in 4 weeks time.

    Do we wait until such a time that they refuse the claim before contacting the FOS or should we be contacting them anyway and let them know if she gets a settlement offer in the meantime?

  • Hello Everyone, I need some help with my credit card PPI claim with HSBC bank.

    I took out a credit card agreement in 2004 with HSBC and did not realise until recently (when I found MSE) that I had been mis-sold my PPI policy. In november 2009 i wrote a letter to HSBC asking them to refund my PPI payments plus interest that I had paid since 2004 and I clearly set out the grounds for my claim.

    Just before Xmas I received a call from HSBC's bangalore call centre asking me to confirm the intention of my claim. I confirmed it and the HSBC call centre member told me that they would fully investigate my claim and respond in writing.

    I did not hear anything from HSBC so I wrote another letter last week enclosing a copy of my November letter. I heard nothing about my claim but received a call from the credit card team (uk not bangalore) asking me to pay more off my credit card as over Christmas I had not paid off enough and had gone over the limit. That's fine, it has happened before but I normally receive a letter. Their behaviour in this instance makes me think they are retaliating to my request.

    I told the uk call centre person about my claim and he said that yes there was a note on file but that I would have to call AVIVA since the policy is with them. I told him that since it was HSBC who SOLD me the policy that my claim must surely lie with them. I asked why I had received a call from HSBC saying that they would look into my complaint in December but now they are advising me something different.

    I asked to speak to his manager. The manager was 'unavailable' but apparently would have asked provided the same advice.

    Can someone please help me. I have trawled through the forums on here and have not seen anyone in a similar situation. I dont want to respond in too rash a manner and ruin my prospects for a claim. I would appreciate any advice you can give.

    Hi SParks, you are correct in that your complaint lies with whoever sold the policy. You only have to give the firm 8 weeks for a full and final response and it they have not resolved or written to you to say they will not uphold then you are now free to go to the FOS. I take it you did send your letters recorded delivery though? Have they replied "anything" at all in writing back to you? If it were me I would always try to keep everything in writing in case you have to go to FOS and refer to what was said.

    It is entirely up to you but if its now some time since the 8 weeks i would be inclined to write to them and state you have waited long enough and that you are taking it to FOS. I would also get the complaints forms downloaded and get it in.

    They have 2 weeks of the 4 that they stated left. I will give them their time to reply.

    In the meantime I will download the complaints form and have a read through it.

  • hello every one had a northern rock loan have details in previous posts wanted some info on amount to be refunded to me have rock says they will not refund in full my premium as they apportion more risk in early part of loan i spoke to FSA to see if this was correct they were unsure but ive just read the small print on my policy (wife keeps everything)it states they are calculating refund under rule 78 can anyone tell me if this is allowed i thought rule 78 was no longer in force thank you.
