I've got a claim in against First Plus for 2 loans, however, the day the 8 week period was up I received a letter from them saying they need another 8 weeks, but I am now entitled to go to the Financial Ombudsman however they hope that I don't.

My question is that, I take it I should raise it with the Ombudsman, but should I notify First Plus that I've done it? Is it liable to push them to a settlement?

    Hi there

Yes you are entitled to do this, but if you do want to wait a little longer for a decision its up to you.;)

Hopefully even though they say require another 8 weeks, it may still be before this you may hear something, I do hope you do with a positive result, but either way now its up to you.
I understand they all have a backlog of these complaints and refunds to deal with.

    Fingers crossed for you.

  • Long time ago now I had an RBS Advanta card, which changed to a Mint Card. I've been paying PPI on the Mint card but can't remember if I paid it on original card or when it changed. I was a) self-employed (now retired) and b) had an existing medical condition. I queried the PPI but was told I needed to have it, (again can't remember when).

I'd claim anyway but I have a balance on it that I couldn't clear immediately if asked to and that's what has stopped me up to now.

    Should I claim?

    Cali

    Hi there Cali

It maybe worth your while requesting for a Subject Access Request (SAR)
They must sent you everything they hold on you, this may help to support your case as well.
An SAR is £10 payable by either postal order or cheque payment, and they have 40 days to comply.

Here is the link to the SAR letter template.
    http://forums.moneysavingexpert.com/showthread.html?t=1475553

    Hope this helps.
I would defo give it a go, more on link below of guidelines of reclaiming:
    http://www.moneysavingexpert.com/reclaim/ppi-loan-insurance

Good luck keep at them, if they don't resolve in your favour then take your complaint to the Financial ombudsman service (FOS).

    Ask for help anytime.;)

  • Thank you for your reply but if I ask for this SAR, are they likely to ask me to pay off the balance on my account?

    Hi there

A SAR is only requesting for copies of all they hold on you, so not to worry, this should not affect anything, or should they not ask you to pay off the balance on your account.;)

  • Hello everyone,

I could do with a little help,

I made a claim for a PPI refund through empire claims, and won.
I recieved £1292 back from the bank, its now in my account.

They charge 25% + VAT which is fair enough their charges are clearly marked.

I got the invoice from them today and they want £551.45 which is the above figure of £1877.28 ( the original PPI amount )

When I questioned them about the amount they said we bill you for the whole amount claimed ( not paid out by yourself £1292 ).

Their terms and conditions do not mention this anywhere, are they allowed to do this?

    Any help would be great,

    Thankyou

    Hi there

    Well done on your success.

    How strange........

That's just like being penalised and charged back for your refund.
This does not sound right to me, hopefully someone will clarify on this.

However, I would contact and/or write to them and ask for a reason for this.
It does not sound right at all.

Good luck with this, remember you have already been out of pocket, why should you more or less pay some of that money back?

    Please keep us posted, cheers.;)

Ive been waiting for over a year. The Ombudsman found for me against Egg re PPI. They advise that Egg have until the 18th January to respond. Whatever that means. I suspect they will "offer" me something which might not be remotely what I figure Im due so Ill have to start "arguing" again. However, fingers crossed they just do what they're told to do and offer me my money back. Watch this space.
