Taking a PPI reclaim to court should be a last resort and you should try all the free options first (which can all be done yourself without the need for a solicitor etc).
absolutely - but if you decide your only recourse is through court proceedings - please, please, please consult a solicitor first
  • Hello, im wanting to reclaim my credit card payment protection and hope you can help me along the way. I had a call from a company called bentley co saying they could do this for me for a fee of £49.00 plus 20% of anything i got back, i declined but was wanting to know if you would recommend a good company to go with that doesnt charge as much? Thank You.

    Hi there and welcome.;)

Personally I would do this yourself and pay nothing.

I would be careful into getting involved with these companies, as it all adds up.

are they still in business and when did you take out the ppi, also was the ppi sold bythe finance company or a car dealer?

did you see my question about who sold the ppi - the finance company or dealer?

It was all done through Mallard vehicle finance and not a dealer.
  • A couple of weeks ago I sent the letter you suggested to GE asking for my money back (insurance was £1,235). The loan started in June 2002 and I paid it off on 29th December 2003. Today I got a letter stating this:

Thank you for your letter of 28 November 2009

Having reviewed the contents, my understanding of your complaint is a claim of mis-sell in relation to the above Protected Payment Policy sold in addition to the loan above.

As you will be aware, the circumstances of your complaint occurred 7 years ago. For such cases, the FSA who regulates our business has issued a ruling that states that complaints older than 6 years old do not automatically qualify for investigation.

To investigate your complaint fully and fairly would now, I feel, be extremely difficult due to the length of time that has elapsed and the inaccessibility of certain records and documents we would require to validate all the facts.

For these reasons, I have decided I am unable to deal with your complaint.

In line with our regulatory obligations, I would like to advise you that this is our final response. If you wish, you may refer your concerns to the Finance & Leasing Association at the following address:

As the Ombudsman operates under the same rules and regulations as we do, it is unlikely that they will be able to assist.

    Yours faithfully

    Resolutions team

I thought that if the policy was still active in the last 6 years the claim was valid? Can someone advise how I should respond please?

    Thanks

    Mark

as it's a complaint about mis selling it goes on the date of selling and you have to have made a complaint within the 6 year limit - this is the Limitations Act 1980, also GE didn't come under the FOS in 2002.

You said you paid it off in december 2003 - did you repay it early?
