PPI Reclaiming Discussion part 4

  • Hi, my first post regarding PPI insurance reclaim, hopefully someone can help.

I took out a loan with Abbey in Oct 2007 for £12,000. Interest on this loan is £7992 @ 14.9% so total is £19,992 over 8 years.

The PPI is £4235.41 but they are also charging me interest on the PPI @ 14.9%, of £2820.59 making a PPI total of £7056.00

    Loan total = £27,048.00 for a £12,000 loan. …bloody disgraceful.

The way I see it, using Martins PPI template, the following criteria apply and I have a case.

    i) Your salesperson implied that taking out the policy would assist my credit application.
ii) Your salesperson did not tell me that the policy was optional and I have since realised that I had alternative insurance cover in the shape of my Abbey Paymentcare taken out at the same branch.

I have been to an IFA and he has stated I have a case for mis-selling the PPI but I am not sure on what grounds?

Are the Abbey out of order adding the interest to the PPI?

    Any advice would be appreciated.
  • I'm trying to claim back PPI from a MBNA credit card, and after sending them £10 requesting a list of default charges etc, along with PPI... a lady from MBNA phoned... I wish they'd just write to me instead! She started speaking about why I wrote the letter in, then after I told her, she then said, oh yes I forgot to say that this conversation is being recorded. I feel like they're trying to trip me up somewhere.

I think when I write to them next, I'll ask them not to phone and to put it all in writing! Has this happened with any of you?

Anyway, basically I was a student in 1999 and my employer doesn't have the records any more of how much I earned per month, or hours worked per week.

MBNA said to speak to tax office and ask for tax code at the time and payments, but after speaking to them, they don't have the info that goes that far back. They said try NI, who I'll phone. But they probably don't.

I was a student at the time, and kind of need to prove that I was, and that I was working under 16 hours per week, which I was...

Of course, I can prove I was a student via the University, but not sure how to prove the number of hours I was working. I don't have the pay slips any more, silly me!

    !

I was told by a very learned friend of mine, a JP as it happens, that you always write/e-mail/fax ... never, ever just rely on a phone conversation.

hi we have had two accounts with black horse we have successfully claimed against one account for mis-selling just waiting for cheque. we have received a letter from them regarding second account stating that because its pre 2005 we cant take it to ombudsmen so tough basically they have actually enclosed a demands and needs questionaire and statement which is actually for another customer. not sure what to do now? anyone help? thanks!

Not sure whether to send second letter but obviously cant put refering to ombudsmen if no success with them it took the second stage letter on the other account before we got results:confused:
  • Hi everyone,

Nassie rang the FOS today and A&L have not replied to the letter sent to them on the 14th of August, asking for her files
  • Hi there, I sent my crdit card reclaim letter for ppi to Clydesdale bank 10 days ago. I also want to claim the ppi for 2 loans from them so do I put them in just now or should I wait for the credit card to be dealt with first? Also I'm unsure if my loans should be separate or if I should do them together as one was arranged at the bank & the other was arranged over the phone. Basically the same reasons for claiming though.Anyone?

Very costly indeed, although you do not need to write the amounts on the reclaiming letters at this point, but it is handy if you have the figures, in case you need to refer to them later on.

Depending on your own reason of what occurs to youm, then you write to them by writing down your reasons, for example, if you had a pre medical condition when you taken this policy out, if you tried to make a claim at a later date, it's unlikely that it will cover you.
Or if you were working for less that 16 hours per week.
Your employer may have protected you and so on.

They have 8 weeks to respond in full, keep at them until they either resolve in your favour or until they issue you with the final decision, which should also enclose details of the financial ombudsman service (FOS), if your not happy with the final you can take your complaint to them.

Post by recorded delivery, this is your proof of posting.

Good luck with this and ask if any further help is required.;)

I would be inclined to ask them to send a copy of the telephone recordings, you entitled to have these on request.
and besides realistically they should normally tell you and let you know before a conversation.

I think when I write to them next, I'll ask them not to phone and to put it all in writing! Has this happened with any of you?
There is a letter template on here somewhere about this, and not only that if they don't listen you can report them I think it's to the Office of fair trading (OFT).

Anyway, basically I was a student in 1999 and my employer doesn't have the records any more of how much I earned per month, or hours worked per week.

So have you sent off a reclaiming letter yet on this?

If not then give it a go, even though its an older case as such but there is no harm in trying, link here for more info with templates etc.

You can always try getting in touch with the financial ombudsman service (FOS), if you get any problems with them and ask if they are willing to investigate this one for you.

Good luck, please keep us posted.

    Hi Showergirl, how annoying!
Did the adjudicator mention anything about this being passed on to the ombudsman?
Or are they giving extra time?

    Hi gil

There is no harm in getting on with them now.;)

If you had 2 loans with them, keep them to the same letter, but remember to write both account numbers and of course as you have the same reasons that is fine.;)
    Good luck.
