thanks for your reply.
No they gave no notice that they were returning the forms only the original loan agreement with a post it saying please sign here and a letter head with the return address. I was not keen on sign it when I spoke to customer services but she assured me that if I signed and returned it and also sent in the letter recorded delivery with my instructions to cancel the PPI within 14 days I would not be charged for this. The cancellation letter was sent the same day as the loan agreement to Barclays head office and the ireland office who deals with the PPI. So i have been paying an extra £65.00 per month for something I asked them to cancel.
I was surprised they still took the PPI out yesterday even though they cancelled it.
The customer services rep said basically I will be treated as if i was refinancing my loan and they said they wanted me to sign a letter agreeing to this even though they have not supplied figures and these will be sent out once the new loan was in place so no idea what I will be taking out.
I told her this was not acceptable and I wanted to see figures and what they were proposing.
So looks like i might be waiting another 15 months.
I will keep you updated and thanks for your help.

I got no notice of them that they were cancelling the PPI on the 19th August but it has taken them 15 months to do it. It should have been cancelled on 29th May 2008.

The way they dealt with this is unfair in my opinion, surely they should have made sure you were happy with this first.
I know they have their own ways but as a valued customer you would expect them to treat you fair here and see if you were happy with the way they sorted this out, as you may have wanted them to refund this directly to you.
Still if they do not resolve this now on how you wanted this dealt with, I would go to the FOS.;)The one and only "Dizzy Di"0 -
I managed evenntually to get through to WF on Thursday but they just said I was in a q and when they got to my case they would cancel PPI and re structure my loan blah di blah! They said I have until the middle of October then to call and chase them up. But it should be before then? Eh!
Got a letter from RBS re Direct Line this morning saying they were looking into my complaint so that is one answered just waiting on the Halifax re my 3 loans with them.
Just waiting on my cheque from Black Horse woo hoo!
Moving onto the credit cards soon I think but dont have a clue if any of them had PPI???
Slow process but I think well worth it in the end!:jLiving Life to the Full0 -

I am having a nice quiet nite my hubby and son are at his mums hehe so have had a great time to myself lol nice and peaceful!
Got to go an pick him up at back of 8 so we can get back down to watch casualty lol sad or what!
its been sooo nice here am just outside Edinburgh and its lovely although an oil tank spilt its load on the M8 this morning and the road between Edinburgh and Glasgow was closed all day sore one!

I've recently sent my first letter and realised I sent it to the lender GE Money and not Loans.co.uk who sold the loans to me.....do I need to send loans.co.uk a letter or will this be passed on ?

Does anyone know how long it takes the FOS to do their thing? I first wrote to HSBC at the end of June and have had a feeble offer. Wrote again and have received nothing.
Wrote to the FOS a week ago and have had nothing yet!

I have just had a response from my Subject Access Request that I sent 2 weeks ago.
Their reply was:
"Unfortunately on this occasion I am unable to locate the loan documentation for the above client, the loan account number and sort code ....................
For the Data Protection Act to apply, information which is not stored electronically needs to be held in a certain format which is easily accessible. An example of this would be if information was filed in alphabetical order, referring to the name of the customer and then the file itself was broken down into different topics. Information held in such a structured format is known as a Relevant Filling System.
As part of your Subject Access Request, the Consumer Credit Agreement, and applications would generally be held by the bank in a relevant filing system and as such would fall out with the scope of the Act. This means therefore that you would not be entitled to them under the Data Protection Act.
If you have any queries please do not to hesitate to contact me on the address shown above."
Any advice would be welcome, as I understand the above is in a rounabout way telling me that I can't have the information I requested and this is a legal loophole for them not to provide my PPI information.

So did they supply anything at all, if not did they return your payment?
How long ago was it that you taken this loan out with them?
If this was within the last 6 years and you live in England or Wales, or Scotland 5 years.
However, if its only the agreement you require in order to check that you had PPI, you can just ask for this for just a £1 postal order or cheque payment, they should supply this by 12 days.
I would write to them and ask them to send you a True Copy of your Agreement (CCA), and tell them you look forward to receiving this by 12 days of the date on the letter and post by recorded delivery, so that you know it reached them.
If you had any accounts live with them over the last 5/6 years they should have held some data on your account and supplied you with them.
In regards of this matter you can contact the Information Commissioners Office (ICO) who can give some advice on this matter, hope this helps and please keep us posted, cheers.
