PPI Reclaiming Discussion part 4

Hi all,
After the usual long and dull wait for the FSO cogs to turn (18 months), I have accepted the final decision in my favour (woohoo) against Egg for mis-selling of PPI single premium with my loan.
After the letter confirming my acceptance from the FSO Egg had 4 weeks to respond to me. They took it to the wire and on the last day of the 4 weeks I've had a letter from Egg thanking me (?) for my complaint and taking it to the FSO, and have said that they will now calculate the repayment AS SOON AS POSSIBLE. Boo. Then they thanked me again for my patience. As if you have a choice!
Conspicuous by its absence, however, was any appology for conning me out of my money and being proven to have acted criminally!
I was wondering if there are now any time constraints on EGG to make the payment? And if this starts to take too long is there any other action I can take - in my company the county court red letter generally gets people to pay outstanding ammounts!

Hi There. Firstly well done for that. There hve been reports of waiting up until 3 months on here. I have waited over a year for Barclaycard to pay me all that was owed to me. (It is now with the Ombudsman for final decision). What you can do is ring them up and ask when they will pay it. If you get no reasonable response with that then go back the the FOS Adjudicator who has been dealing with your case.
FOS usually like you to communicate with EGG firstly though. Good Luck:mad:0 -

I've been trawling through the Reclaim PPI section of the website and it goes into great detail about how to reclaim PPI on a loan if you feel you were missold it.
However, I just paid off a £5,500 loan with the Alliance & Leicester 1 year early. Can I simply reclaim the PPI for that year (that I didn't use) or do I have to justify being missold it?

Hi there Rusty,
If mis sold then you can reclaim, and another is maybe you've received an unfair rebate on settlling early, if you've not been mis sold, thought I would mention this because not everyone realises you can complain about this as well.;)

I calculated the outstanding amount and the rebate was £50 cheaper, so I don't think I have grounds for complaint there.
However, I did have a pre-existing medical condition that had me off on long term sick from work in 2003/04. I located to another area and changed jobs and after a year of good health I took out this loan with A&L for £5,500 in April 2005. I do feel that the consequences of the pre-existing medical condition were not explained to me enough in terms of it making me ineligible to claim if I was sick with the same thing and off work again. In fact I am unsure if they asked me at all. Luckily, I was not ill and have been well for over 5 years
I'm not sure if that's good enough to warrant a complaint and whether to do so or let it go. I am tenacious so would be willing to see it through. How gittish can they be generally?

I think you should go for the mis selling then.
Yes its good enough, it was worthless to you if you could not make a claim, if they did not resolve this and you take this to the FOS, I'm sure they can see your side of it.
So give it a go, however do not back down if they try fobbing you off wiht a standard response that you must have been aware of it because you signed up for it, that is standard, you will more than likely have to move on to letter 2 or if they confirm the FOS, then move on to them.

I put the claim in just over 3 weeks ago now and thought I would call today for an update. What a pointless waste of time. I was told "there is no update, you probably won't get a response until the full 8 weeks is up". Nice!

A reply from my MP after I sent a rarther scatjing email about how long the FSCS legal team were taking and the effect that it's having on real people...
Thank you for your email of 23 June. I completely understand your frustration – indeed anger – over these delays and the financial implications.
I have sent your latest email to the FSCS asking the Chief Executive to take good note of your further comments. I have also, as prompted by your email, sent our correspondence to the Financial Secretary to the Treasury asking for his response to the points you make regarding pursual of repossessions and court judgements for debt whilst the FSCS process drags on.
I hope to be able to write again with further news.
