i would love the address for HFC - will give them a go. i sent my initial letter to Dunfermline but for some reason it was forwarded to Halifax. when i rang marbles yesterday the guy gave me an address in Birmingham, and have sent a letter off to there today following rosemahairy's advice. It all seems very confusing to me to be honest so we'll wait and see. thanks for your help everyone.

Hi, hope your hayfever's a bit better today.
I got a letter back from TPF, thanking me for my letter of complaint! Came back via return of post, so very quick. Generic customer service letter with standard complaints leaflet. They've referred my letter to their specialist PPI "concerns" office in Manchester, so will wait to hear from them. But the 8-week clock is ticking!!They claim their PPI team will contact me within five days to confirm receipt of my complaint. So far, so very good customer service. Pity the PPI wasn't good customer service when they allegedly mis-sold it to me!! :rolleyes:

Hope you don't mind me asking but did you get your PPI on a CC or loan from TPF? And how long ago did you take it out? I have a CC with them that I initially opened in about 1999 I have been paying PPI on the balance every month and have one at least one occasion called and asked them to cancel it, which they never have. Just wondering whether I should go ahead and try and claim.
If any one had any success with this please let me know! I'm reading back but there is so much to read and take in!!

I took out a now fully repaid egg loan for 10,000 in September 2004. I still have my long agreement but there is no mention of ppi although the agreement is very short and sweet.
Can anyone advise me if I had ppi or what should I do next

Hi got a letter to day from FSA stating that the adjudicator recommends Egg makes a settlement to me. Good news i hope, however will they pay or will they take it to the ombudsman, they have till 6th May to respond. Anyone know what will happen now??

Its looking good so far then.
Going by what we have been through so far with the FOS.............
What normally happens at this stage is:
The Adjudicator will expect them to respond to their conclusions in writing by a certain date, (normally a few weeks).
If they are unable to reply fully by that timescale, they should let them know without delay, the FOS may also request further time if requested.
Their reply should be either:
Confirm they are willing to pay compensation fully in accordance with the Adjudicators conclusions.
Where in this case the Adjudicator will write back to you to confirm this offer is satisfactory as a full and final settlement of this complaint;
or
They should explain why they are not prepared to pay the compensation that has been recommended, including any specific reasons for any disagreement with the overall conclusions the adjudicator have reached.
And supply any supporting documentation that have not yet been provided.
They may refer the matter to the ombudsman for a final determination of this dispute, where further information may be required by both parties.
This is the final opportunity for them to forward any further information, before a final determination is made.
If they do not reply within the time required of do do only in part (for example by omitting the information requested if they choose to reject the Adjudicators conclusions that you pay compensation), then the ombudsman may proceed to a final determination of the matter, without the benefit of further comment and may draw adverse conclusions from their failure to respond).The one and only "Dizzy Di"0 -

I would try to reclaim on this then with your reasons, here is a link with more info and templates:

Its well worth a shot, so go for it.
If you have no longer have the agreement for this then it may be difficult to retrieve this from the company, as its gone 6 years, but if the loan was not paid up until 2004, they should hold some details at least for your loan, like the calculations and breakdown of the settlement etc, so it maybe worth you requesting for these first of all free of charge, but other than that request a SAR (Subject access Request), where they should send everything that is requested on the SAR going back as far as 6 years.
There is a charge though for this at £10 cheque or postal order payment, and they have 40 days to comply.

When you write to them to reclaim, they have 8 weeks in full to respond, if you hear nothing at all by 8 weeks then go straight to the FOS, if they do respond but do not resolve your complaint then write back with further information and ask them to reconsider.
Post all letters by recorded delivery to ensure the letters been posted.
In the final response they should give you details on how you can take this further, normally with the Financial ombudsman service (FOS) if eligible.

Thanks for your reply. I have already sent them a cheque for getting my actual bank statements going back six years. Would this cover the loan stuff or do I need to pay again? The loan was linked to this account and was paid from it.0 -

They should actually send everything to you.
Did you request a SAR in letter?
If not get back to them as soon as possible with the letter, tell them you already sent £10 towards the cost of this and you want to make sure all what is requested in the SAR is sent to you.
All by 40 days of when you first asked.;)
Do not pay again because £10 is the correct charge for a SAR which covers what you have asked for and the information in the SAR, good luck, any problem let us know.The one and only "Dizzy Di"0 -

Have rechecked the loan agreement this morning and all it details is the interest rate no sign of interest amount to be repaid. Going to investigate further .

Just a quick update on my claim with Cap One..... I received a letter from them on Sat morning basically saying that they still maintain that my PPI was not mis-sold and have offered me a 'Good will gesture' !! Now there's a few points I need advice on please?? :rolleyes:
1. They are obviously only offering me a partial amount of premiums paid and I know it should be at least 4 times that amount!!
2. I wrote to with a SAR a couple of weeks ago.....they have cashed my £10 cheque but I don't have any info.....should I wait for this before replying??
3. They have stated in their letter that if I accept this good will gesture, they will reduce this amount from my outstanding balance......My account has never been in arrears and I have never missed a payment!!
I would really appreciate some help as to what to write in my reply

Well I have today received the 'Final Response' letter from Capital One stating that although they still maintain that PPI was sold correctly, blah blah blah, they are willing to refund all premiums paid plus interest to the tune of £1065.24..........BUT, I still don't know if this amount is right? :rolleyes:
As I mentioned in my above post, they still haven't replied to my SAR request BUT HAVE CASHED MY £10 CHEQUE :mad:
They have included a form for me to sign and send back....should I ask for an extra £10? :rotfl:
