  • Marsh, I think case and point with regards to the FOS, not being united when supplying Correct Information

A case worker is the person before it goes on to an adjudicator, they will put your evidence with what Tesco send and then pass on to an adjudicator if Tesco dont make an offer. Good you now have a bit of a timescale for this first bit. Goodluck

I don't know Marshallka, the girl just said I had been allocated a case worker, is that the same as an adjudicator. I am just surprised that this has happened so quick. I thought it would have been months before anything happened. I will wait for the postman to deliver the letter and will let you know what is say's. I just thought that I would let you know that the ombudsman work to a time scale.

I think a case worker is the one whom looks into this for you and communicates with the company, think if this cannot be sorted out by a case worker then it goes to an adjudicator, not too sure though

Yeah, I was told different with my bank one. . I was told by some guy, (not the adjudicator though) that they had requested copies of everything from Co-op and co-op had not responded. It worked out well though as when they did respond it was with the goodwill gesture.;)

I just hope that Tesco respond one way or another as I was sick of being messed about by the RBS. I know I shouldn't really be complaining as a lot of people have been waiting a lot longer than me. I just wanted to pass on that bit of news hoping it would help others. Is an adjudicator the same as a case worker

Yes that is correct.. The Case worker decides on its merits, even if the case worker refers it back to you can appeal and request adjudication

Marsh... think of it another way. What have I to gain by telling you lies?

And what has both the lender to gain by telling you lies, or mis-truths.

As I said dont take my word for it, talk to a lawyer, heck even talk to petermb, we have had many a discussion about this.

    Hi Incipience

Thank you for explaining all this to us. Petermb is very knowledgeable about this and has helped many people on these FORUMS. Not just by what he does but about the invaluable advice he gives.

With my legal claims I have gone for the lender as advised.

Think people need to be a bit more open to this really cause otherwise we go from pillar to post. If I had not decided to go down this route with some of my claims I would still be backward and forwards arguing over pennies and how to work it out with the FOS and others.

My commission statement shows a sum of £850 which is 5% of the loan and nothing for the PPI by the looks of it. I assume that is because IF we did use a broker as they say, they only sold the loan and it was FIrstplus that added and typed in the PPI on the agreement. I also don't EVER remember using any broker for this as from what I can remember, we called direct from the TV advert. The broker says we called from a teletext ad.

Standard commission for arranging the loan 2-3%. Commission for arranging the loan with ppi
5%.....It is included in the commission figure.
I am a former Broker, former IFA and former compliance officer, for my sins.

However, I have since seen the light.
  • Max, we are all told to from so many that the broker is responsible, but what they all fail to mention is that the lender is also responsible.

I dont know how many times I can stress this. The FOS are ok for Vanilla cases..
  • Hi all, have received a reply from THINK mortgages re ppi reclaim due to miselling, they confirm that we completed a remortgage application in nov '03, where we opted for a lump sum insurance poilcy built into our mortgage advance, they no longer have a copy of this due to the time scale that has lapsed since the sale.HELP!!
