  • I have rang the ombudsman and the girl on the phone told me I have been allocated a case worker for my claim against Tesco PF.They have sent me a letter explaining this They have also sent out a letter to Tesco yesterday asking for my files. I asked them if there was a timescale for Tesco to reply and they told me they have a month from the date of the letter to respond. So they do work to timescales in which the companies have to respond.

  • Then take legal action then.

    Did you provide any evidence to dispute the brokers involvement, did you provide the underwriting sheet that had no evidence supporting this brokers responsibility.

    Did you provide evidence that the insurer paid the lender and not the broker?

    Marsh dont give up. You are trying to fight this on your own, which is fine, however they both are trained to make you think its a futile case, you need the same.

    Contact the insurer and ask them who they paid.. this is all vital evidence to back up your case.. if FIRSTPLUS did not disclose who they paid for the sale, and the Insurer say they paid FIRSTPLUS, then firstplus can not now disclose details of payment to the broker, for this would make them in breach of the DPA for not disclosing all the details.

    Marsh, you got a case.
    My commission statement shows a sum of £850 which is 5% of the loan and nothing for the PPI by the looks of it. I assume that is because IF we did use a broker as they say, they only sold the loan and it was FIrstplus that added and typed in the PPI on the agreement. I also don't EVER remember using any broker for this as from what I can remember, we called direct from the TV advert. The broker says we called from a teletext ad.

    Does this mean you have an adjudicator now showergirl...:D or is case worker different.

    Just goes to show how each FOS worker says different. Co-op were weeks providing info and I called and complained on this one and was told that they do not give the company any deadline as such. Nice one for you showergirl. Really pleased.

    I don't know Marshallka, the girl just said I had been allocated a case worker, is that the same as an adjudicator. I am just surprised that this has happened so quick. I thought it would have been months before anything happened. I will wait for the postman to deliver the letter and will let you know what is say's. I just thought that I would let you know that the ombudsman work to a time scale.

    Yeah, I was told different with my bank one. :confused: . I was told by some guy, (not the adjudicator though) that they had requested copies of everything from Co-op and co-op had not responded. It worked out well though as when they did respond it was with the goodwill gesture.;)
  • Marshy you are arguing your own case here, the evidence is undisputable.

    Bullet point the chain of events that led up to the loan.
    Then make comments from the evidence supplied in BOTH SARS.

    Outline all the Firstplus Documentation and note all its assertions.

    SAR the Insurer, to find out who was paid and how much.

    The Lender Paid the Broker 5% of the total loan (without PPI)
    so the loan would have been just £17k is that right? if so it is a regulated agreement. Yes?
