    hi can u help me with a few questions got my win with f/plus today have been paying £132 on a ppi since july2006 can u tell me how much i should recieve and can i demand it paid to me rather than off the loan thanks

    Wow Sue this will work out to be quite a bit, not to forget the interest to add as well.

    Had SAR back from Littlewoods but it was the wrong thing!! :mad: They sent me all my catalogue account NOT our loans so had to phone them and tell them, despite my letter clearly stating I wanted the loan stuff they still sent all that rubbish! :rolleyes: Might have to let this one go as loan ended 2004, started 2002 but might show something on account :confused: We were defintely mis-sold ppi on this but just wish I'd have known about ppi mis-selling alot sooner, oh well :rolleyes:

    While I was in a mood I called HFC for an update on old OH loan from 2004. It hasn't even been assigned to anyone yet! :eek: The lady was nice enough and just said that I was entitled to go to the FOS as it had passed the 8 weeks (originally wrote Dec 08) but we haven't the paperwork so need to go to the PO to get our very last £10 postal order :rolleyes:

    I'll get them in the end! :D

    In regards of Littlewoods, even though they did not supply all the info you expected due to the dates of 2002, they could have still provided anything they have on this as from 2003 to now (the last 6 years).

    I would write back and ask them why haven't they supplied the info for this actual matter, tell them they have failed in providing you with all the SAR your entitled to, or you will consider contacting the Information Commissioners Office, if they cannot supply this, they should let you know why.;)

  • oh sorry Di I forgot to add I was in one of those moods today so felt brave and called them to ask about the SAR stuff. I spoke to a real nice lady and she said that my SAR had just been passed to the general department for data protection and she would contact the department that deals with loans to get the information from them.

    I am thinking now the whole thing was a fob off but she did seem genuinely sorry that I had to call to ask about the other info. When I asked her about the loans she said that they would only have records from 2003. Our loan was from 2001, topped up in 2002 and ended in 2004. So I might just get the end of it? :confused: It's a stab in the dark but you have to try.

    I will write to Littlewoods and just remind them of the info I really wanted and go from there.

    Toffee I just caught your post, do you mean you think you'll only get the tail end of PPI rebate cos they only go back 6 years in their office records?

  • OK, well you are entitled to all of the miss-sold PPI regardless of their paperwork. The bank will only ever tell you that they only have 6 yrs cos thats the minimum time frame they have to keep thing for, it doesn't mean they dont have more papers though.

    When writing to them, calculate the PPI rebate from when the loan was first taken out (plus contractual intersest and then 8% compensatory interest) and present this as your settlement figure.

    You should state that if they are unable to provide evidence that counters those PPI spends from beyond 6 years, then they'll have to pay. It's fair and reasonable to take it that this PPI was paid from day one as that is what your agreement states - unless they can prove otherwise, they'll have to pay it.

    I got this notion from a solicitor last month with my latest claim. A CC going back to 1994... and they've calculated the maximum possible PPI spend (which is right as it could have been if there are no statements to suggest otherwise) - and they have to produce documents if they want to argue against it. If not, it's rebate time.

    Thanks for that, I have no original paperwork, no account numbers for the loans. I only got the info when looking through OH old bank statements from that time and had proof of the exact monthly fee that was being paid when the top up took place etc. Thats why I say it is a stab in the dark as I thought they could just say 'no we haven't got the info' and that would be the end.

    We can't even recall how much the loans were for it was so long ago, I doubt they were for much though probably one or two thousand maybe three max but the date of the first one June 2001, my son was born May 2001 and I was out of work and OH has always been self employed so we know we have a strong case of mis-selling with this one as both loans had the gold policy on.

    I'm just kicking myself at throwing the paperwork out now!:mad:
