    Arh I see, so basically this should have been dealt with at an earlier time within the 6 month timescale? This is mainly the reasons here for some.

    Maybe you had personal reasons why you did not continue to deal with this matter earlier, maybe health issues etc, you can try contacting the FOS if you do have a good reason you think may help you case in order for them to consider:

    If you can write to them to request a copy of the agreement, enclose a £1 postal order or cheque payment, they should supply this document by 12 days of your request.

  • I am in the process of claiming Credit Card charges from Halifax and I was wondering if anybody had claimed the PPI insurance that was sold with the card on the basis that they told me the charge would be 78p per £100 but they did not state that the amount was per month not as I thought per annum. :confused: I would be gratefull for any advise Thanks and keep up the good work.:T

    Dont ever take a companies word for it that the FOS wont look at a complaint ,ring them (FOS) first.

    Hi Useless have not heard of that at all. If that is what you believed though then write and tell them how you felt you were miss sold.

    Mate, if they are actually saying that the PPI was bought on the phone legitimately and that therefore you have no case, then they'll need to provide evidence to support their claim.

    Hi guys, hope you are all well?!

    OK, so I am absolutely livid!! I'm shaking I'm that mad...lol

    Anyway, sent 1st template letter off to C(r)ap One a couple of weeks ago and just got a reply today.

    It states that I was sold PPI during a telephone conversation in August 2008.......My account was opened in August 2002!!! Anyway, I rang them to check how long I had been paying PPI on my account and the guy told me he could only go back 6 months???!!!!!! I told him I couldn't remember getting a call from them in August last year for PPI, and he said.....'We don't cold call, you must have rung us!'......AS IF!! So, to cut a long story short, I've just dug out a couple of statements from 2007 and PPI is on there.....I'm presuming that they have got the date wrong and did mean 2002?! I also think that this could be their standard fob off letter...

    I'm going to write the stage 2 letter this weekend, along with a SAR and £10 cheque......

    The saying "Right arm doesn't know what left arm is doing!!!" seems to spring to mind!!! :rotfl:

    Belive me, they know EXACTLY what they are doing. IF PPI was sold on the phone, then ask for all call transcript copies relating to your account from day one - they will "not have them", but like I said above, if they make a claim saying it was sold within their rules, ask them to back this up - if they cannot, then they leave themselves wide open.

    The SAR is a good start. Templates are good, but add some punch, tell them they have mis-sold because (and state reasons as pure facts) - if they dispute it then ask for the evidence they have to uphold their claim.

    It's all about putting the pressure on them to prove themselves.

    Hi there

    Yes I have in fact been successful reclaiming the PPI on mine through the Financial ombudsman service (FOS), if you feel you were mis sold this for any reason, go for it hun, and of course if its worthless to you as well.
