Hiya
You could check directly with the branch, who should be able to confirm, but if you want to request for a Subject Access Request (SAR) you can of course do so if you want to.
There is a full SAR letter below link, you enclose £10 cheque or postal order, they have 40 calendar days to comply.

Barclays have agreed to send me a copy of the agreement out free of charge. I took it in 2006 and only finished paying it last year.

Hi there still new to this site although i have a few claims in the processs , today i had my third failure for ticking the box! Does anyone know of any successes via FOS with regard to being turned down on this basis ? Any thoughts are really welcome thanks dave

Letter expected today from First Plus...
No Letter!!
Telephoned them to enquire about the case and was told that they had until the close of business today to make the decision and they could not disclose any details over the phone.
Told that there had been a letter sent out on 1st September following a telephone conversation I had with them on the 30th August, guess what...No letter!
I feel like I am being fobbed off.
I have been told to expect a letter tomorrow with the decision. I won't hold my breath.
Should I be patient and cut them some slack (they do not deserve it) with the amount of claims they must have?
Come on FP pay us what you stole from us!!!!0 -

Hi conker what a pain,you might as well wait now,you've waited this long by the time the fos sorted it now you'd be drawing your pension lol, you know what i always say, no news is good news,hope you hear soon. steve:)0 -

Hi dave this is quite unusual that there all being turned down,i know that credit cards are notoriously harder to prove misold as most of them say that as the cards were "sold" either online or by mailing shots they get away with saying that the cards were sold on a non advised basis, some of the cards are very hard, i've personally had the fos turn down one of mine even though i never had a policy document some of there (the banks) decisions stink frankly, all i can say is if you can get hold of other evidence progress it to the ombudsman or failing that possibly MCOL which is court basically but it's done online, but i believe there is a charge for this, good luck with this dave. steve:)

I have copies of the applications for mbna/virgin and both have the words WE STRONGLY RECOMMEND PPI above and below the tick box , i have sent them both to FOS explaining that i feel that there advice led me to take ppi and that had i known that the policies were worthless i would nt have taken them, will have to wait and see.
When barclays rejected me along the same lines today i felt that they were just using it as a way to weed out the easier claims from a rejection point of view?
Over the weekend there was a thread from loopyloz84 who had been rejected along the same lines and given a final response , she had asked them to take another look after a fantastic email and they had said yes! virgin i think.
I have sent an e mail to them tonight just to see what they say
I was hoping there would be some successes to from a simlar line to cheer me up 1

Dave i've now read your post this changes things somewhat the wording on the paperwork you have stating that "we strongly recommend ppi" makes this an advised sale, you have them, progress it to the fos after telling the bank that by telling you, they the bank strongly recommends this insurance it is no longer able to hide behind a non advised sale tag,i would approach the banks and challenge this strongly. i really think these are worth pushing dave as obviously the sales process has to be a lot more vigorous for an advised sale,let us all know how you get on. steve (ps i know it's with the fos now but i really think if you put this argument to the banks again it might save you a wait at the fos)0 -

The fos wil look at "what is considered fair and reasonable" as well so it doesn't only take the relevant law of the land into account i feel you are fairly safe with these lenders dave,i'd say go for it.0
