PPI Reclaiming Discussion part 4

Hi,
I would be interested to hear if anyone has used a CMC?
Stupidly, I did starting about a year ago, but had heard nothing from them for months; they ignored my last email. Heard from them now that I've had an offer though (£3900).
Their last email said "this matter now rests with the Ombudsman" but when I rang the FoS (very helpful) they searched under my name and postcode & nothing had been received. They advised that I ask the CMC to prove, via a case number allocated, that the case had been filed. I'm thinking if not then that's breach of contract?
I hope this info. could help someone else too.
I've seen a suggestion that it's a possibility to claim compensation because the whole PPI thing has nearly cleaned some of us out; is anyone thinking of pursuing that? It's nearly destroyed me, robbing Peter to pay Paul.
I hope this is the right thread.0 -
Please if anyone can help or advise we will be most grateful. My cousin was mis-sold 2 PPI's, one for his first loan and another for the second loan as he was in a very poor financial situation. He originally had a loan for £2000.00 and his first PPI. He lost his part time job, couldn't keep up the repayments so was then given a second loan for £800 (and a PPI costing £2500). My family became involved and on his behalf got in touch with Lloyds on the very last day before the cut off date of 6 years. They paid for a copy of all statements but even through the FSA have only received details on the second loan so to this day they still do not have all statements. Lloyds wanted to give him a very small amount of compensation (not even covering the PPI's) which he refused and thus he was put on hold. Now they have received a letter from the FSA stating that they don't think he has a case because he was both unemployed and only in part time employment whilst he had the loans. EXACTLY. Isn't this one of the reasons why he was mis-sold? They seem to be on the side of LLoyds. Where does he go from here? My family is thinking that his best option is to say that he will not repay anymore of the debt - now up to £12000 (but put on hold) and that they can take him to court if they want but really he should be repaid the PPI's and given compensation. He has lost absolutely everything, he sold everything he owned, he is now on benefit but working part time again to try to turn his life around which has given him the courage to ask his family for help.0

There are a lot of these cmc's out there that at the first sign of trouble they bail out and send it to the ombudsman, so in effect there charging you to do something that you could easily do yourself anyway, saying that if you've signed the contract you will probably have to pay the cmc there slow they generally don't tell you whats going on, if you are going to use one (there are good cmc's out there) make sure that if the claim gets rejected the claim gets handed back to you with no charge, to fos yourself,as the fos is a free service anyway, you could check on your cmc to see if they hold a licence as if they don't they should'nt be trading anyway. good luck0 -
Thats a good point, a word with the tax office might help try and spread the liability especially if you werent higher rate for all the years. Got any accountant buddies or advisors, spose you could offset by doing some pension planning.

That's my situation, for about 7 of those years I wasn't hitting the HEL tax rate, so I hope so.
I've got a friend who went through becoming a certified accountant so hopefully she can help me.
I am also going to possibly I guess ask Lloyds for a more detailed breakdown of how it's calculated so I can work out what I 'earned' in interest each year and try and get taxed on that year - this shouldn't be taxed as if I've had a 10 year savings bond! Or so I hope!0 -

When were these loans taken out and are you sure it is the FSA who have said he was not mis sold and not the FOS?.cousin_david wrote: »Please if anyone can help or advise we will be most grateful.
