Hi. I like a few others it seems have contacted companies requesting copies of original loan agreements. I recently had a letter back from Santander stating that as the account was close with no outstanding balance then they didnt have to provide details. Does anyone know if this is correct and if so any other way i can get hold of my loan agreement?0

Hi treetrunks, unfortunately this is the case but if you are looking for a specific agreement as you say you are, you could send a cca request to the bank enclosing a cheque or postal order for £1.00, failing the bank still refusing to play ball you would have to sar the bank which would cost you £10.00 again postal order or cheque, the bank has to respond to this within 40 days and these have to be provided under the data protection act 1998, word of warning do not sign your sar request. there;s a template on here if you need it but i'd try a cca first, good luck.0 -

£54.75 x 43 = 2354.25 refund to you
8% Interest 43 months = £361.75 (289.40 if 20% tax payer)
£2023.79 taken off loan from outset
Future payments should be £162.33

Thanks Niggly
So if I chose to have it taken off the balance of my loan it will clear it, or most of it?
That is what I plan to do when Lloyds uphold my claim. I would love to spend it but going to do the sensible thing.
Thanks again your brill.0 -
Santander were the only bank that did not go to court when the other banks did :A,they will hopefully conclude your claim in the 8 weeksSo my partner has set the ball rolling with Santander. They said they have 8 weeks to come to a decision from the date the complaint is logged I thought it was 16 weeks. Luckily we had all paperwork from the quotation done in July 1994 and no where is the word optional used in connection with the Paymentcare policy, also as he is self employed he told them it is unlikely he would be able to claim on the policy due to class 2 and 4 contributions not being high enough to get unemployment benefit and that he felt this was not all explained properly by the advisor and finally that he felt he had to take this policy like the home insurance and pension that he has to have alongside the mortgage and he felt very pressured, I do hope he explained things correctly as he gets a bit panicky on the phone to official type people,
. How if any refund is due will they work it out, he pays £19 per month and has since August 1994, phew thats 17 years or will there be a maximum number of years they will refund. Any help would be great, thanks,
