    Hi All,

    I have been trying to claim back my ppi from Lloyds TSB.

    1) I asked for a copy of my agreement, which they sent. On my agreement it has a nice big check box on the first page stating I have read the terms and conditions of taking ppi. Now I really did just check cause I felt I would not get the loan, also I did not get fully explained what it was for.

    2) I sent of my first letter from stage one on this site. I got a reply from them trying to justify themselves.

    3) I sent of letter 2 from stage two on this site. 6 weeks have passed and I have not heard a word from them? I did say in the letter within 14 days.

    What should I do now?

    Also I wrote to another bank about 4 months ago asking for a copy of my agreement, they cashed the £10 check I sent them but never sent a copy of the agreement.

    What should I do?

    Hi there

    So you sent the £10 off and you never received the SAR information, and they cashed this in ??:eek:
    Contact the ICO here: https://www.ico.gov.uk/Global/contact_us.aspx

    Also they have 8 full weeks to respond, if they do not you can still continue to take this to the Financial ombudsman (FOS), I would ring them first and see if they suggest just moving this on with them now they may say give a little extra time with a timescale, here are the FOS contact details here:

    Please ring them and let us know what they say about this.

    HOWEVER, don't forget that assuming all this rebate business is correct for the main 15,000 main loan and they have correctly adjusted the situation to be as if PPI had never been added--you can only get the refund on the PPI bit of WHAT YOU HAVE ACTUALLY PAID.

    In simple terms, do you think I am entitled to request this:

    (2005 original PPI single premium + interest charged up front) - (2006 early settlement rebate) + (8% statutory interest PA on deprived money)

    Seems to make sense to my non-financial brain although I'm sure its not quite that simple!

    HFC agreed that I should receive £936 for a personal loan of which they were unable to state whether it was sold correctly - was looking forward to this. I wrote to them on 21st Feb stating that I would accept this amount for one part of my claim (personal loan) but not in full and final settlement as there are 2 homeowner loans still in dispute. Rang HFC today and they have refused to pay me as I am still in dispute with them. I tried to explain that these are 3 separate issues and that they should pay back my money but they are still refusing. Looks like I am going to have to wait for FOS to deal which will be ages away. Can they refuse to pay out if they have admitted fault on the personal loan? Any advice or help would be appreciated, thanks

    Hi there

    You have told them they are separate, so I would have thought they would treat them separately, but it seems they are dealing with this as an whole complaint.

    Why don't you ring the FOS anyway now to see where you may stand with this by explaining what you have posted above, they should be able to advise on the best direction to take here and answer your query for you.

    Got letter from the Ombudsman today, saying:-

    "FirstPlus is willing to make you an offer in line with my recommendations, save for the payment for distress and inconvenience, in full and final settlement of your complaint.

    FirstPlus is making this offer as a gesture of goodwill and without any admission of liability

    You now need to consider this offer. The offer from FirstPlus is less than the redress that I indicated in my assessment as it does not include the payment for distress and inconvenience

    Your case could be referred for an ombudsman's final decision in which case I consider it likely that an award would be made for distress and inconvenience, Nothwithstanding this you may wish to consider accepting this offer"


    So yayyyyyyyyy! They sent me a copy of their letter to FirstPlus which I still need to get my head around. Basically it says that they must put me back into the position I would have been in had I taken out the loans but not the PPI policies.
