Hi guys a quick bit of advice needed, sent off my sar request, got a letter back from the dsar section of yes you've guessed it LTSB today i'm about to draft them a response, could someone give me a quick confirmation, we don't have to still provide a signature under section 7 of the dpa do we? i know these things change, i've no intention of signing it.

thats fine guys i've copied a letter i've found and pasted some bits in myself to say that under the dpa 1998 i'm not required to sign my signature i have enclosed two utility bills as proof of address,details i don't want my signature pasted onto old documents and i would'nt trust them not to do it.0 -

Just started on this forum, so i hope anyone out there knows an answer to my question .
I have had a secured loan for over 5 years now , in march they paid out 9500 pounds , this was because i did not make a claim on the insurance , but i have 25 more years on this loan including the insurance which is around 90pounds a month this seems like im payin out a lot of money?
Does anybody have any ideas?
Oh the loan is with First Plus.0 -
Whilst clearing out have just found old storecards for Evans and Monsoon. Both were with GE Capital Bank. I have no idea when the accounts were opened or closed. Done so well so far with reclaiming I might send them in for the cost of a stamp.
Also I have found paperwork which suggests I had another loan with Barclaycard, although I do not have any account number or paperwork, just the dates on a credit report. Is it worth an email to ask them or should I complete a SAR? I remember reading somewhere that Barclays had paid someone on a loan they hadn't even claimed mis-selling on.0 -

I am sure I did read somewhere that you can still make a reclaim, even if you've received a payout after the 5 years, because the problem you have now is that you will no longer be protected for the term of your loan and still paying for the ppi as it was added as a front loaded policy at the start of your loan.
To to do this, you pursue the broker by completing the reclaim questionnaire, send to them, complaints or their head office, keep a copy for yourself as well and allow about 8 weeks, although they may ask for more time due to the backlog.

Hope this helps, also state before they make a point of this, that even though you have received your payout, your not happy knowing that you are no longer protected for the term of the loan, but you will still be paying for the ppi.

Well done on your success up to now, you have done very well indeed. :beer:
Maybe you could email them, give them as much info as possible, even old addresses if this applies to you whilst having accounts with them, and they may email them to you, or call into a Barclays branch, ask them to check the files/systems for you.
I emailed Lloyds last week in regards of account numbers via the mid 90's and they sent them on to me by email.

Send this letter to them ASAP.
We/I believe we were mis sold the ppi on the above account number.
1)We/I were not told that the ppi was in effect another loan that was added to the original loan and was repayable over the loan term with interest.
2) We/I were not told that the ppi only covered us for 5 years, but the ppi would still be on the loan to term end with interest.
3) We/I were told that if we did not make a claim on the ppi ,after 5 years we would recieve the ppi as cashback, and to look on this as savings plan.. But were not told that the ppi would be on the loan to term end with interest and the cashback of ppi would not include the interest that we paid over the 5 years.
In line with the FOS recommendations it is requested that the overall situation be restored as if PPI had never been included. This will entail:
a) A refund of the monthly payments that have actually been paid towards the overall loan in excess of those that would have been needed, if the original loan had been sold without the PPI policy;
b) Restructuring of the loan going forward so that the amount owed, the monthly repayments, the term and the charges reflect those that would have applied, if the original loan had been sold without the PPI policy.
c) In addition, interest at the rate of 8% simple per annum to any excess payments made from the time each payment was made to the point that Firstplus pays them back to us. We/i believe we were not given enough information on this ppi to make an informed decision. Had we/i known the full cost of this ppi we would not have taken it.
Unless you can prove without doubt that this PPI policy was fair, reasonable and suitable for my/our circumstances we/I will require you to rearrange the loan as if PPI had never been included on the aforementioned loan.0 -

i've taken a leaf out of your book di and just asked LTSB for my two credit card account numbers we;ll see what they come back with lol0
