FirstPlus refuse to payout the cashback due to our ongoing complaint with CapitalOne - can they do this?The adjudicator is in agreement that we have been mis-sold and our complaint is waiting for final decision from the Ombudsman.

    Adjudicator's recommendation is that CapitalOne should offer us redress and pay back premiums plus 8% which we understand is the standard when dealing with PPI claims.Today the adjudicator has written to us and confirmed that CapitalOne are not prepared to offer the redress set out but is prepared to offer a refund of premiums paid, associated interest and an additional interest of 8%???? This is a final offer from CapitalOne but no monetary values have been offered.

    We don't understand why they would offer us a refund if they don't believe we have been mis-sold and although the adjudicator cannot gurantee that the Ombudsman will agree with him surely the fact they have offered a refund implies mis-sale??

    Can anyone please offer any advice if you have had experience in similar situations?

    I'm with beamer they would'nt have made you an offer if they did'nt accept liability,cap 1 are just as likely to tell you where to go then to make an offer of payment, you've got strong grounds for a claim.

    Hiya

    I take it that Loans etc were the brokers?

    If the lender is still active write to them to send you a copy of the Payment Protection Policy details, I had to do this with mine, and its not always something you have enclosed with your loan documents, and its requested for separately.

    So write to the lender, ask them to post out the above for as soon as possible, obviously enclose your loan account number with them.

    As soon as this arrives back, the details of the insurers/underwriters are enclosed, the policy booklet is all about them, you then take your complaint to them, and if they do not accept any liability, the FOS will consider taking the case on, because these would have been regulated.

  • sent email to yorkshire bank at aqu.ppi@eunabgroup.co.uk and keep getting a message from postmaster at hotmail to say delivery is delayed, would you send it again and send a copy to CEO???

    You could send a copy to the CEO, tell them you require attention on this matter and receiving messages of the delay.;)

    Well I spoke with Natwest PPI team, apparently the credits to my account were nothing to do with anything they'd done. My case is still awaiting to be finalised and she said hopefully I'll hear by the end of July.

    I am somewhat confused who else whould have cancelled the PPI and credited me back the premium and interest then - only them I reckon!

    Can I ask when you submitted your claim to Natwest? I've also have a claim in the queue, but it seems to be taking ages :mad:

    Well I also got 2 credits in my account yesterday £126.75 and £234.54, I did request for my PPI to be cancelled on Saturday, but I have 20 payments left on my loan the amount left owing is the PPI amount, I've got a claim in for the PPI but given they have tops 16weeks to resovle they've got till the end of august to sort it out.
  • i have recieved a letter from barclays stateing they would make an offer no later than august 31st as a gesture of good will,right at the bottom of the letter it says *in the event you do not hold a ppi policy with us you will not be eligible for any refund.can anyone tell me what this means as i have settled my loan 4 years ago which the ppi policy in question was linked to. any help would be great thanks.
