In order to buy a car a few years ago we took out a loan with Lloyds bank. This was done In my name from my bank and I do pay quite a bit for PPI. The thing is I can't remember if they offered it or I asked for it, whatever the case all I know is that I have paid out a fair amount of money for it. My loan finishes next year but have just found out that my husband is to be made redundant in a couple of months (not good at 62yrs old). Do you think it would be worth a chance for me to make a claim and see what happens. We could certainly do with the money.0

Hi, it does not matter if they offered it or you asked for it, the point is does the policy cover your circumstances and when you took it out, did it cover your circumstances then ??
Check through your PPI carefully and no doubt you will find clauses that will not be applicable to you, this is what the PPI scam is all about.
If after reading the policy you feel you were mis-sold and that means the advisor did not explain the policy in detail, then claim against Lloyds0 -
Hi all, been looking at all the threads and was hoping for some advice. Our situation is very complicated..........
We have a PPI complaint against HFS Loans (now CapitalOne) for PPI mis-sold to us on a First Plus loan. The PPI Premium of £21,551 attracts £37,072 interest over the 25 year term.
Initially when we contacted CapitalOne about this back in June 2010 they advised us that they did not believe we had been mis-sold but as a goodwill gesture will refund us £15,355.64. This was far greater than premiums paid to date as we are paying £195.41 per month for PPI (at that time for 4 years only). In addition to this they would offer an additional £252.61 for which was never explained what this was for plus our PPI would be cancelled but we would have to continue to pay the premiums for the term of the loan.The 60 month cashback term ended in March 2011.
So far we have paid all premiums to date and we continue to pay this premium as our complaint is ongoing. FirstPlus refuse to payout the cashback due to our ongoing complaint with CapitalOne - can they do this?The adjudicator is in agreement that we have been mis-sold and our complaint is waiting for final decision from the Ombudsman.
Adjudicator's recommendation is that CapitalOne should offer us redress and pay back premiums plus 8% which we understand is the standard when dealing with PPI claims.Today the adjudicator has written to us and confirmed that CapitalOne are not prepared to offer the redress set out but is prepared to offer a refund of premiums paid, associated interest and an additional interest of 8%???? This is a final offer from CapitalOne but no monetary values have been offered.
We don't understand why they would offer us a refund if they don't believe we have been mis-sold and although the adjudicator cannot gurantee that the Ombudsman will agree with him surely the fact they have offered a refund implies mis-sale??
Can anyone please offer any advice if you have had experience in similar situations?

Sounds like Capital One. ???? you are right, if they thought they were right, they would not offer you anything so, they are accepting a mis-sell of the PPI.
Take no notice of the "final letter rubbish", nothing is final until they re-pay you the full amount and you can tell them that.
If you have read through this forum, you will see that Capital One have a very bad reputation, they have already been fined for mis-selling PPI's
As I keep reminding everyone, the mis-selling of PPI's is an act of fraud, not just an "oops we made a mistake"
Capital One sold dodgy PPI's which were not worth the paper they were written on. STRAIGHT FRAUD. Fraud Act 2006
Remember this when you contact them again0 -

Further to my letter from Halifax on 3 june saying they had received our complaint and would deal with it within 8 weeks I have now had a letter basically saying:
"We are writing to provide you with a further update. I am sorry for the delay etc. I can confirm we will respond to your complaint as soon as possible and in any event sixteen weeks from the date we received your complaint (which was about 31 May). This is in line with the specific requirements that the FSA has published for the handling of PPI complaints. You can find full details of the FSA's requirements on their website blah blah blah. I am sorry that I have not been able to respond fully to your complaint but rest assured that we are working to resolve your complaint as soon as we can"
Anyway is this more delaying before telling us to forget it and is 16 weeks normal? Sorry I couldnt find my original post to make this make sense.

Update - Received another letter from Halifax yesterday (exactly the same as the one I received on Friday) one dated 23 june and one dated 24 june. So thats where the money is going..... sending out duplicate letters and still not sorting out the complaint. dont their computers speak to each other!!!

Hi, I'm trying to persue a PPI claim from Loans Etc however I've hit a block as I am unable to confirm the underwriter. Can anyone help, or do you have a policy booklet I can borrow. My loan was taken out in around 2004.0

Sounds like Capital One. ???? you are right, if they thought they were right, they would not offer you anything so, they are accepting a mis-sell of the PPI.

Hi All still waiting for my decion with lloyds tsb Had the standard letter saying they are looking at my complaints. I had a loan with A & L have got no paperwork on it wife burnt it all when loan finished,Can I still get details from them on this loan finished 6 years plus ago Thanks in advance oggie0

Hi oggie send in a cca request it'll cost you £1.00 in fees but you can then request your specific agreement. the fee is payable by postal order or cheque personally i'd send a postal order as that is made out by a third party (post office) send to your banks data department,good luck. (or you couid try your luck oggie and just ask the bank, although there not obliged to give you the information if the loan is paid up and closed,but worth a try.)0 -
