PPI Reclaiming Discussion part 4

Details are a little hazy at is was a long time ago.
I had a TSB account (from a very young age) and when I turned 18 (Feb 1995) I got offered a £50 overdraft. This all sounded very grown up and I took it out but they insisted on me taking out insurance at £7 a month if I recall correctly. I remember sitting with the bank manager (also called Martin) in the branch and explaining what I did at the time (studying full time but working in the RAuxAF Regiment part time earning circa £250 a month). He went through the list of exclusions with me (would I be parachuting I remember being one) and (obviously because it makes them money) he told me I could be covered and would be paid the £250 a month in the event of anything happening to me that meant I couldn't work.
I subsequently broke my foot (at college) and was out of action with the RAuxAF for approx 3 months (turned into longer as it rebroke a couple of times). When I went to claim they came back saying that I wasn't covered because I worked in the military. We argued that I was told specifically that I would be covered after telling them about my work. They said - tough, not covered, as a good will gesture they would refund my premiums as I shouldn't have been covered in the first place.
Now - would I have a claim or not? Because they refunded my premiums and I accepted them (I had no choice as I saw it I was over my overdraft and they were then charging me extra) does that mean I can't claim? Would I be able to claim for what they should have paid me because of my geniune claim based on the original discussion with the bank manager (at least £750 if not more). Is there any mileage in the fact that the times I went over the overdraft during the period I had it were down to the extra £7 a month they were taking out and I subsequently paid extra in charges on? (I am guessing not for that one, it was my bad money management that led to being less than £7 remaining when it was taken out).
I am interested in if there is the potential for a claim before I go approaching the bank as I can see it costing me £12 including postage to get the relevant paperwork on the agreement and would rather save that if someone knows it would be folly.
Thanks in advance.
Hello there
Below I have posted a link to a new thread, still within these reclaiming threads, but as this is a little complexed there are ones on these threads that will have the right advice to follow on this one.
So please feel free to post your query on the link below and give it a title as well. Good luck with this.

Has anyone got a link were I can download the PPI questionnaire claim for for WFS? I was using Nochore to make a claim for my PPI refund I had loans from 2003 to 2007 all paid off early due to topping up the loan and PPI was provided with each loan which I never needed as I have employer benefits being a civil servant up to 2005 and then we transferred to a company and still had the same benefits plus the same women I seen over the years for each and every loan always included PPI in the loan I was told on the first one I needed it to get the loan and everyone there after I assumed I must have to have it to get the new loan, Nochore tell me I can make the claim based on this but the loans that are after 14-01-2005 I may as well do myself as it's a case of completing the questionnaire and sending it to them, fair play this saves 25% of the claim going to them, wish they told me this last week I could of got things moving
Rang WFS/FSCS on 0845 373 0386 spoke to a women who said the questionnaire will take up to 5 days to turn up.
Will the form just be the one off the FOS site ?
Hi there
I was trying to search the claim form for someone the other day from the FSCS site, and either missed it but could not find it.
However, when I made a claim through the FSCS - different company in default they send me this in the post.
If your having problems, I would personally call the FSCS or maybe ask them to email to you otherwise.
Good luck. The one and only "Dizzy Di"0 -

Thanks Di, I'll drop them an email tonight, once I've got the claim form from the FSCS to claim against welcome I'll keep hold if it if anyone wants a copy.0 -

Great news about Barclays, could someone advise me please. I complained in 2008 and did receive a letter back with an offer to part refund ppi. I rejected it as it was worthless.
I have now resubmitted a claim today with a very strong claim of mis-selling as my husband is the first named on the ppi and is self-employed!!
Do you think this u turn they have done is largely due to the fact they have discovered just how many were mis-sold or have they suggested they will only payout for complaints made by april, because they are not prepared to address any further claims? sorry but i am alittle confused. My load was with first plus and the ppi with barclays insurance dublin.
Thanks
You may have to wait for 16 weeks or longer if i remember right, as you have just put the claim in, those whose claims were put on hold will be dealt with by the end of august.
Does this help?.
I dont know what will happen in your case as you had an offer made in 2008 and rejected this, because if they gave you chance to go to FOS when you declined the offer and you did not do this after the 6 months, maybe they now wont look at your case, hopefully someone who knows more about this will help you more.0 -
Woody123456, was this a claim for mis sell or to cancel the ppi?.
As i understand it, they are not looking at rejected claims at all.
This is terrible as FP ppi is a "win".
Let us know what reply you get to your letter.0 -
Hi There,
I'm new to all this so need help with what to do next.
I used the template PPI Questionnaire and sent it off to GE Capital/Santander. I have today received a response from the complaint resolution team. My argument was that I was sold the store card in store and was told what to sign and where to fill in where the assistant crossed not being aware that the PPI was optional and not valid if unemployed which I was at the time.
The response basically says I signed the agreement and would have received the information about it afterwards. that the form clearly states only sign if you require protection and that I need to prove that I was unemployed at the time by providing NI contribution proof for that time.
I have rang HMRC and requested the info and will be with me in 7-10days . I'm stuck now with my response, yes i can prove i was unemployed but I know what these companies are like and want to make sure I get my response correct.
Can anyone help?

Hi Claire
I would tell them the policy was not discussed by the adviser and if it was then you would have opted out of the ppi, but with being told to sign where the adviser marked or told you to - you done as asked. Maybe you assumed it was an all in one package perhaps at the time.
I used to think it was all in because not being told otherwise, and also assumed if cancelled then I would have to repay the whole amount back.
Then of course enclose details of your unemployment, this is proof straight away anyway and a good reason alone without the other issue as above, as you would not have been fully protected by the cover, in otherwords the adviser sold you and made you sign a policy (ppi) that was worthless to you.
Good luck. The one and only "Dizzy Di"0 -

The exact same letter dropped through my door this morning from Santander too, with regard to a Debenhams Card. They also enclosed a copy of my credit agreement that has crosses (made by the shop assistant) and I too just signed by the crosses!! I was working when I took out this card but only 15 hours per week as had a young family, so there next argument was that my husband would be entitled to the cover instead - but he was and still is self-employed so neither of us could ever have claimed. I would never have agreed this insurance.
I have written back asking that if they can 'honestly' say that the shop assistant clearly went through all the appropriate questions with me regarding the insurance - as they can't.
They have asked for proof re NI contributions for the year for both myself and my husband - otherwise case closed. I have written back a reply today stating case definately not closed.0
