    Have you already claimed on the insurance?
    Until January 2010 it had been generally assumed you couldn't make a mis-selling complaint if you'd already made a successful insurance claim. Yet proposals from the regulator now mean more people could be entitled to compensation.

    Anyone who has claimed on a PPI policy can still submit a mis-selling complaint, using the timeframes above, though the chances of success are unclear. However, even if you're not successful, you may be able to cancel your insurance

    Sounds like johnnyone had a pre loaded ppi, which in most cases do not run for the full term of the loan yet the interest does, are these no longer sold and frowned upon(quote di here) and therefore a mis sell in itself.

    Hello there,

    I wonder if anyone can help - or my other half was self employed when he took out a business loan to purchase a vehicle, the loan was a buy now, pay later loan of £5k and there is quite clearly loan protection insurance of £1,263.15 added, the interest was 8.60% over a 60 month period.

    Hubby has never claimed on this, but now there is a twist, we had to enter into an IVA towards the end of November 2009 and this loan had to be a part of that can we still claim this PPI back? Am aware that it may well be offset against creditors on the IVA but if we can get a bit more off them all the better.

    Hi there

    And yes you can to what I'm aware of, and as your already aware if successful they will award the refund towards that and anything remaining plus interest is normally awarded directly to you.
    And of course with the ppi added within the loan, the ppi is now worthless to you in your circumstances, so once sorted it will be reduced on what you owe.

    Follow the link below, to the reclaim questionnaire on step 3, complete and send to the ones who set the loan account up - Head office or complaints dept, and remember to keep copies, allow 8 weeks for a decision, good luck.

    Just for info for other hsbc customers....

    Sent 2 copies of the questionnaire (first posted 10.05.11) having heard nothing I emailed the bank via internet banking and eventually got this reply:

    Dear Mr Penniless

    Thank you for recent e-message

    Please find below a response from the relevant department.
    ********************************************
    I refer to your e-message dated 31 May 2011.

    I confirm that we have received the Payment Protection
    Insurance Consumer Questionnaires on 13 May 2011 and on 20
    May 2011.

    The department concerned have been advised to deal with
    your query as soon as possible. Please accept our
    apologies for any inconvenience caused to you due to the
    delay.

    Should you have any further queries, please contact us.

    ********************************************

    HSBC Internet Banking Customer Support

    Fingers crossed that I might be getting somewhere!? If they've advised the department to deal with my claim asap it's becuse they're getting fed up of my emails LOL.:rotfl:
