Just had a letter from Capital One saying they won't be paying out, they're saying that I opted in (done online in 2004) to PPI, don't recall doing it but suppose it's possible.
Worth pursuing or should I just give up on this one.
On another matter when I took out a graduate loan with HSBC in 2000 I was told in no uncertain terms that I must take PPI or I wouldn't get the loan, this was done in branch face to face so there won't be any proof and I did make a claim for one month, do I have a leg to stand on?0 -
Thanks Di, i remember that thread you set up. I remember people getting back the ppi but it wasnt taken off the loan.
Maybe it is different with Welcome? as the FSCS are helping them with the compensation claims, as Welcome are not in default yet?,as i understand it anyway.0 -
Hi can anyone advise what to do next
i took out a loan in 2005 over a 10 year period which included PPI as i was informed at that time i couldnt have the loan without it. i explained that as a civil servant being made redundant attracted 3 years pay and incase of sickness salary is still paid upto 1 year plus i had enough equity in my property should the worse come to the worse. In 2007 i called back to the bank asking for the PPI to be cancelled which they refused. December 2010 i completed the forms Martin Lewis recomends to complain to the bank and request a refund. They sent me a holding letter. February i used the ML forms again to send to the Ombudsman. They have replied giving me the Barclays version of the ML forms and asked i sent them in again to Barclays. I have sent these in and still not heard anything from them. What do i do next?
in the mean time i continue to pay the PPI can i demand this is cancelled immediatley?0 -
we had car finance with ge capital woodchester but it was about 2001 ppi was added and it was settled about 2003 is it too old and too late to try and claim back the ppi we did write to them but they said they wasnt regulated just wondered if anything else we could do0

If you do you could end up with the term and the apr being different.
If you win mis sell then the total ppi is taken off your loan, this reduces the balance and your monthly payment goes down by the ppi monthly amount, you will get back the ppi you have paid to date with interest.
You need to contact barclays and ask have they recieved the forms that you sent. If they have not, then you need to ask for these to be sent again. Hope this helps.0 -

You need to find out who the insurer was as you may have to go down this route.
When did you contact them last?, as they are no longer authorised.
If you cannot contact them now, have you any paperwork for this loan? you may need the insurance document.0 -

Was this a loan or credit card?
If a loan - where the repayments were made from the bank account, and if you bank online, this should allow you to go back about 7 years maybe more, the account number is normally shown next to the monthly repayment.
If a credit card, the details would be shown on monthly statements, or on the card itself if you still have hold of these.
Another option maybe an experian credit report for £2, sometimes they do this free for 30 days, or equifax, if you google these organisations in they will explain more in detail, however, this would be going over the last 6 years.

It was a loan. He changed bank accounts when we got together as we opened a joint account. He hasn't got any paperwork from before as we took out a loan together to cover his debts and binned old paperwork when we bought a house together.
We'll try experian.

Evening everyone,
I am in the middle of a PPI claim with my Bank after having read up the guides on here. Loan was taken out in Feb 2007.
Sent off the letter, stating mis-sold, I was told that to get the competitive rate I was after I had to take out the PPI. After reading all this I have filed a PPI claim stating mis-selling, I've got about a year left on the loan & policy. Sent off the letter on 23rd of Feb.
Got a letter back with acknowledgement of the complaint stating they would get back to me in 6-8 weeks which would've been the 20th of April - the day of the high court ruling I believe.
I've now got a letter back dating the 21st of April stating they are still aiming to resolve my query through their internal complaints process as quickly as possible. Stating the ruling in December 2010 regarding how complaints of sale of PPI policies should be investigated.
Now to quote a bit of what I am sure is a generic letterThe BBA (the main trade association for banks) asked the Court to review these new regulations on PPI complaints handling issued by the FSA and guidance published by FOS. This challenge was brought because the BBA is concerned that the FSA and FOS are changing their rules retrospectively, by applying new standards to past sales.
The Court has now delivered it's decision and the parties to the legal proceedings may now consider whether they wish to appeal the decision.
In the meantime, we will be providing updated information on our customer websites setting out our position, what the judgement means for customers and what will happen next as soon as we can.
We wish to handle and resolve all complaints quickly and to the satisfaction of our customers. However we may only be able to assess your complaint once the legal proceedings, including any possible appeal, are concluded. As soon as we have any further information regarding your PPI complaint we will contact you.
We can assure you that this further delay will not count towards the time limits in which you can refer your complaint to Court or FOS, should you disagree with the final outcome of our assessment
From that the 3rd paragraph makes me think my complaint is now on hold. And the sentence in the 4th paragraph - However we may only be able to assess your complaint... is not a definitive is it?
Should I call back the complaints department and state I do not wish to wait for this ruling. Should I call the FOS about this?
I am wondering if I am one of the first to receive such a letter considering the 8 week deadline date and the Court ruling.
Any help would be much appreciated, we have the money to pay off the loan sat here waiting, but were waiting on this judgement before clearing any debts to then get a mortgage!0 -

Hi folks,
Hope someone may be able to advise me about reclaiming PPI on an old credit card I had with Alliance & Leicester about four years ago.
The PPI was definately mis sold but the thing is that when I managed to pay it all off I shredded all the paperwork as it was such a relief. These had the account details on them. Is there any way I could get these details from somewhere?
