Evening everyone,
I am in the middle of a PPI claim with my Bank after having read up the guides on here. Loan was taken out in Feb 2007.
Sent off the letter, stating mis-sold, I was told that to get the competitive rate I was after I had to take out the PPI. After reading all this I have filed a PPI claim stating mis-selling, I've got about a year left on the loan & policy. Sent off the letter on 23rd of Feb.
Got a letter back with acknowledgement of the complaint stating they would get back to me in 6-8 weeks which would've been the 20th of April - the day of the high court ruling I believe.
I've now got a letter back dating the 21st of April stating they are still aiming to resolve my query through their internal complaints process as quickly as possible. Stating the ruling in December 2010 regarding how complaints of sale of PPI policies should be investigated.
Now to quote a bit of what I am sure is a generic letter
From that the 3rd paragraph makes me think my complaint is now on hold. And the sentence in the 4th paragraph - However we may only be able to assess your complaint... is not a definitive is it?
Should I call back the complaints department and state I do not wish to wait for this ruling. Should I call the FOS about this?
I am wondering if I am one of the first to receive such a letter considering the 8 week deadline date and the Court ruling.
Any help would be much appreciated, we have the money to pay off the loan sat here waiting, but were waiting on this judgement before clearing any debts to then get a mortgage!

I've noticed that its the same read up as on Lloyds TSB ppi complaints, the wording is exactly the same.
You could give them a ring to make sure, my 2 seem to be held back as well, and i have been told the same.

If you write to the lender, ask them to send you the payment protection policy booklet details, the insurer's direct details are enclosed, and gives you the procedures of when your making a complaint to them, although you pursue them the same way as you have done the broker.
I had to do this as suggested by the FOS, and my case is still ongoing with the FOS, I was told it would take some time though.

Hi folks,
Hope someone may be able to advise me about reclaiming PPI on an old credit card I had with Alliance & Leicester about four years ago.
The PPI was definately mis sold but the thing is that when I managed to pay it all off I shredded all the paperwork as it was such a relief. These had the account details on them. Is there any way I could get these details from somewhere?

You can still make a reclaim if you have the account number, and if you definately knew you were paying out on ppi and your reasons.
I have made reclaims with just the account numbers.
If you no longer have the account number handy, you could write to ask if they could send you a copy of the credit card agreement by 12 days, and you enclose £1 cheque or postal order.
Or another way which will cost £10 cheque or postal order, is to request a Subject Access Request (SAR), there is a letter template below, you can tweak to your requirements if you want to.
They have 40 calendar days to comply.

But you may have to give as many details as possible on both requests as above if you don't have the account number, full name, address, Date of birth, anything you can remember etc.
To make a reclaim, complete the FOS questionnaire, send to the head office or complaints dept of whom set up and sold you the account, they have 8 weeks to give a decision, and if your not happy with the final outcome you can complain to the FOS (Financial ombudsman service) and send them a copy of your complaint to them.

There are in hertfordshire though, I think that they may have said to you they were not regulated to maybe make you go away?.
People on this site (me included) have won mis sell from the 90s, so this "we are not regulated" is a get out of it letter.
All this means is they will not deal with loans from before they were regulated.
Have you anything with a contact number for them? as this is who you will have to phone for the insurer details.
once you have the insurer details, then you submit a mis sell claim to them and if they say "no way", then you can put your complaint into the FOS.
This may take up to a year or longer though, so be prepared.0 -

Hi there, i am afraid we all have to wait the final outcome of the JR!
this is so annoying, it is just the banks putting 2 fingers up to the FSA and FOS, the banks believe they are invincible and do not have to abide by rules and regulations, and lets face it they dont, there is no agency or governing body in the whole universe that can make them do what they dont want to do.(rant over!)
With regards your claim, i would if i were you ,pay the loan off as you have the money, as you will only being paying the interest on this, when you can settle it now and get a rebate of interest and ppi
ask for a settlement figure now and make your own mind up , if the banks lodge an appeal (and this is highly likely) this could take over a year to resolve and maybe even longer.
If you need a mortgage then i would clear this loan.
Settling the loan should not make a difference to your ppi claim, if you win, you will get the ppi paid to date back with interest less the rebate they give you for the ppi.
To get clarification on this, give FOS a ring and double check.
If the banks win, then you have not been waiting for over a year with money sat waiting to pay off a loan when you could clear the loan now and that will look better on your credit file when you go for a mortgage.0 -
you would be better writing in and complaining and keeping a copy of the letter - Central are allowed 8 weeks in which to respond0

done some phoneing around today it turns out it was ge money not central capital who was the broker so some more calls tomorrow i think thoughts anyone

I would therefore make your reclaim complaint to GE Money, think they are dealt with by Santander now, but in my son's case GE did direct the complaint to Santander.

To be honest his only taken about 3 weeks, so was pleased with that, and it will be Santander I expect that will deal with yours as well, and they are in my opinion pretty good and have not held back due to the judicial review, so hope you don't have to wait about too long, the best of luck.;)The one and only "Dizzy Di"0 -
