Hi - I have just sent off my form and letter to Egg - I couldnt believe that I was actually able to log on to thier site and get my credit card number even though they closed the account down a couple of years ago (I even remembered my password can you believe?). At one point I had two credit cards with Egg (one had originally been a Boots credit card that transferred over to Egg) but they merged them both into one account after a while.
I am certain that I had PPI insurance on this card (or even both of them) but you know when you have paid for the registered letter and passed it over the counter suddenly you start to doubt yourself - did I have PPI insurance? I am certain that I did but what would happen if I didnt and I had been mistaken. The statements that are showing up on the internet only go back to June 2009 and I think that was after they had closed down the account (do you remember when Egg shut a lot of their accounts down more or less overnight) and I must have cancelled the PPI insurance - well I hope I did anyways.0 -
For anyone who's interested in the Judicial Review - saw the following on another web site
The outcome of the Judicial Review into PPI Redress is expected shortly. Whilst a decision has been reached, it will not be made known until officially handed down by the Judge. This is expected as soon as the legal teams of the various parties can fix an avaialble date in the Judge’s calendar.
The Judicial Review (JR), which commenced at the end of January, was instigated by the British Bankers Association (BBA) against the Financial Services Authority (FSA) and the Financial Ombudsman Service (FOS), challenging the ability of the FSA to impose fines for breaches by lenders of certain rules and regulations rules as well as challenging the calculation methodoly for determing consumer redress. The legal challenge is expected to run on, even after the Judge has delivered his decision, as it is likely to be challenged by the losing party.
Thanks for the update on the JR. I have just had a letter from FOS appologising for the delay AGAIN and they stated that they will be back with another update at the end of May.:(:(:(

hi i have about 10 ppi claims on going at the moment so kind of know what companies are doing at this moment of time ie review tatics i sent my egg complaint few weeks ago and was hoping i would be as lucky as a few people on this site have been. they sent letter after 1 week confirming they received it then few days later letter to say they couldn't give me response due to review.it's still within eight weeks so just wondering did the wins on here get this letter or did they just get payed out.

I know that the advice is not to cancel PPI on a loan before mis-selling decided (or not as the case may be). However is it acceptable to cancel it on a credit card as only applied on a monthly basis anyway. Just realised it is still added to my Barclaycard.0

Hi All,
Sat night about midnight and what do i decide to do,, sort some ppi's out, I did start this last year but stuff happens and stupidly i didn't continue it thoroughly.
Just a heads up really and a bit of advice if poss please?
Capital one i wrote to them 2 times last year and never had a response so i have just done a letter using the template its only for £122 but fingers crossed i may hear something this time. This is for late payments and fee's . My credit limit has only ever been £200 and had this card since about 2004 so £122 is minimal compared to some but still unfair.
Halifax i have a credit card with, i had PPI on this starting at about £5 per month now rising to about £12.00 I wrote to them last year saying i don't feel i actually accepted PPI as aswell as being in employment i have always had a second job from home so would always be able to make my payments.
I then received a standard " sorry you feel unloved and poor" letter back from them on 26th January 2011. I heard nothing back just a phone call to say it was being looked into and then on 16th March i receive another letter similar to above saying they will consiuder it and let me know, standard im sure, but there was nothing in the letter that stated how long until they will be in touch, Can someone let me know what time limit they are to work on please?
I also have a reward account with Halifax which i have constantly been in the overdraft for a while, I make regular payments but their charges are the ones like for many of us are putting me back up. I had a lot of problems with this last year where they were removing money from one account to clear it leaving me short, then id be on phone for hours and writing letters asking them to not just do that as it was causing financial difficulty etc etc. I did pay the £10 for all my details on this account. Eventhough i have not started anything with this am i entitled to at least add up what charges i have incurred and see if i can reclaim? My main point for this and any other financial difficulty is that when i was out of my main work or on a low income i was visiting my bank regulaly explaining my situation and felt nothing was there to help me at all, they never asked if i had a loan, a credit ard nothing just kept charging me.
One more thing if i may... sorry to go on... in about 2007 i took out a loan for £2199.00 the opening balance was £2365.35 i diid not and have never had ppi on this and never missed a payment, but upon taking the loan soon after i received a Bank Of Scotland account with a £500 visa limit card on it, I never requested this but at the time thought it was linked to my loan or something else so naively just carried on with it. Are they allowed to do this as i have continuously gone through my paperwork and can find NO letter asking if i agree to it or signature or anything.
Sorry i rambled but thought it best to get it all down in one rather than keep asking

You have done the right thing in writing back to them if you never received a response from them, normally if you did receive the final response and you were not happy with it, then you would have 6 months as from the final response letter to complain to the FOS, but as you've heard nothing then in my opinion there is no harm done in trying again.Good luck on this, but if you want to as well post about this one as its in regards of charges on the reclaim card charges thread here.

I would chase them up on this one, they normally have 8 weeks to make a decision, write and tell them your still waiting and you've not received no decision, however you are in your right to make a compaint to the FOS if this have been ignored once the 8 weeks have passed, so let them know this as well.

For this one, for advice I would post on the very first link I posted above where you will receive the best advice, but what I would do is write to them only and do not deal with them directly as such or on the telephone.
The 2nd link posted above should give details on what to do also if in hardship, good luck.

I would write to them and ask them about this, tell them you didn't ask for it and wondered what it entailed, ask them to send you a written explaination, you could also write with a simple letter, enclose £1 cheque or postal order, ask them to send you a copy of the loan agreement by 12 days.
All details of the loan should be disclosed on the loan agreement.

So... Capital One have responded and have advised that they're not paying out, as I supposedly agreed to take out the PPI over the phone when I called to activate my card in 2004. The trouble is, I don't remember the conversation, I never had any paperwork confirming the Ts and Cs and I have no paperwork advising that I even had PPI insurance on my card, I just paid it every month until 2008.
Capital One are refusing to give me a copy or full trancript of the telephone conversation, which I find odd, as I thought I legally had a right to information held about me.
They have also said this is their final decision. Is it worth me writing back threatening the FOS, or do I just write to the FOS?
I thought my luck was going to run out at some point!!! 2 out of 3 aint bad! 3 out of 3 would be better!

So sorry to hear that.
Now when you mention that they refuse to send you any proof of the calls, did you request this in terms of a Subject Access Request (SAR) there is a letter template for this below link and they MUST comply and send ALL data they hold on the account.
They have 40 calendar days to do so.
For this though you enclose £10 cheque or postal order.

If they have these details and informed you that you agreed on the phone then they must still have the evidence for this somewhere in your data, so they should be able to prove it.
I would be wondering myself otherwise.
If they still don't send you the copies of calls in forms of transcipts of cd etc, then I would write back and tell them they must have had proof of this on data and you will now contact the Information Commissioners Office (ICO) to make a complaint.
(If they have the details then they should disclose them, afterall its what they are saying you asked for and I would not take their word for it without the evidence).
You can still continue to make the complaint with the FOS if you want to.
Was it the final decision?
If not then maybe you could ask them to reconsider otherwise first.
