Apologies if this is getting a bit out of sync, but it's a reply to thank 'amersall' for answering my post number 14377 and 14381 of yesterday...
I've just come off the phone to Barclays and they say they are not able to make an offer in respect of the PPI at this point in time as they are ALL subject to 'judicial revue'.
Could someone on here (amersall or di3004 are hot on this sort of detail) advise me if this is correct, or is it just a fob-off?
Just to reiterate, I have a letter from Barclays dated 29th September saying they will contact me again by 29th October,but that date came and went and still nothing....hense the phone call to them today.
Question is: Should I write to them again, giving them a set period (a couple of weeks in which to make me an offer), after which I will go straight to the Ombudsman. Or what ?
Any thoughts on this please?

Firstly, it's taken a while to find my original postings (I had made a note of the messages numbers : which were 14377,14381 & 14400 on a piece of paper here, but those numbers now seem to refer to someone else's posts....oh well).
Anyway, I sent a letter by special delivery (cost me £5.10!) giving Barclays a further deadline to 23rd November. I told them that my complaint was sent ahead of their supposed judicial review date of 8th October (my first letter to them was on 1st September).
No response from Barclays ! so now I am writing to the Financial Ombudsman and putting it in their hands.
I''ll keep you all informed of progress:)

I recieved calculations from lloyd on credit card ppi today:j:j
My problem starts is the way lloyds have calculated the settlement figures.It was a platnum credit card it was opened in aug-02 and closed in sept 07,the reason it was closed was lloyds introduced a new cc" lloyds airmiles duo" the balance was transfered to this new card.The old card account was closed.The new credit card has new account numbers and is still open.
When lloyds worked out the calculations they have used the start date aug 02 up to 25/11/2010.(last Thursday)
I think they should have done two different calculations one for the old card which would be "where the card account has been cleared and closed and the ppi has been cancelled"
And for the new card which is still open "where the card account is still open but the ppi has been cancelled"
By doing it the way they have they have not paid the difference between the revised closing balance and the original closing balance and the 8% interest on the old credit card.

its difficult to comment as not all the information is available, however if you signed a seperate agreement for the second credit card then technically speaking Lloyds should have dealt with these complaints as seperate claims,
if it was a case of just transfering from one type of card to another without signing a new agreement then they are correct in what they have done. sometimes when the account changes slightly they do issue a new card number, (it happened to me with Barclaycard, but it was technically the same account)
did you do a SAR request and go through the documentation to confirm how the accounts were changed.
if Lloyds are adamant they are correct, and you still feel they are wrong then you could speak to the FOS to get their take on it, it could be a way lloyds are trying to wriggle out of paying you additional redress.
are we talking about a lot of money here in terms of the 8% as if you do forward your complaint to the FOS it could take a lot longer to resolve.I'm proud to say that the banks no longer take money from me after becoming debt free0 -

I think you are right as i did not fill in a new agreement for the new card.I claimed back charges on the old card last year and on the letters from lloyds it said account number and that the account was closed.Thats why i thought the calculations would be different on the closed account.
i did not do a sar and i dont know what the 8% would be

Hi I am new here and not sure if this is the right place, I have put a claim in with my bank for PPI as i was told I couldn't take the loan out unless I took PPI and even the man at the bank said I was miss sold. I wrote to the bank in September of this year and receive a letter on the 7 October to say they would look into my claim and get back to me after 8 weeks. The 8 weeks are up this week and I have just phoned my bank and they have said they have still not made a discussion yet and that I should receive a letter this week, I am with Lloyds TSB could you please let me know what happens now.

Hi and welcome
Normally Lloyds keeps you informed at regular intervals, and will let you know if they need more time.
Hopefully you will receive a decision very soon.
You could also email them on the link below to chase them up now and again, remember to give them your claim complaints number as well.

However, your also entitled to make the complaint to the Financial ombudsman service (FOS) if they have not give you a decision once the 8 weeks have passed, so what I would do first though, cos the FOS can also take some time before they can investigate, is email and ask them for a date timescale of when you should hear of a decision.

So sorry to hear this, and how incompetant of the muppets!
What I would do (if you have a printer) print off the proof of when they supposedly had received them and ask tell them you would appreciate it if the 8 weeks could be as from that date shown on the proof of receipt, give it a go, its not your fault they lost your complaints.;)

Hi Di,
Its been a while so thought I'd update you on my progress. I went back to hsbc and gave them a rocket and fired off emails to their customer services dept with proof of postage and original docs I'd submitted in June. Got a response on the 14th September acknowledging my complaints stating I would be waiting 8 weeks. Given that they'd lost the originals I allowed the process to run its course.
On the 13th Oct they contacted me again by letter asking for more time (standard stalling tactic) but did supply docs for me to escalate to the FOS.
On the 28th October they contacted me again to say that they would be unable to provide a response, as the standards which my complaint should be assessed (FSA policy statement on PPI complaints) are subject to legal proceedings between the BBA and FSA.
Now having scanned the forum I'm aware there are others in a smilar boat. But is there a form of words I can use to rebuke their stance- as surely they have an aboligation to continue to process claims? And what should I do next?
And I'm still paying my PPI on my exisiting loan, despite stating I am not happy paying it/don't want it- so should hsbc put payments on hold etc when complaint have been made about financial products?

Hope your well, and so sorry to hear of this!
I did actually email the FSA about this matter - when all this Judicial Review/Freezing of ppi complaints came about.
And below is the copy of the response received.
You could give the FSA a ring for the quickest method, explain your situation and see what they suggest to you, they will highly likely suggest going the FOS avenue, but if your reclaim was before all this came about in October - in my opionion its one they should be dealing with and not freezing.
You could though contact them and mention that your case was actually before all this came into affect.
Have a look at my response from the FSA and see what you think, this may help you decide on where to take yours from here.;)

Thank you for your email dated 11 October 2010 concerning the decision by certain banks to stop handling PPI complaints.
I would like to provide some information concerning PPI complaints which may be helpful to you. We have proposed a package of measures to reform the PPI market and protect consumers. The package will ensure customers are treated better when buying PPI and more fairly when complaining about it. Firms have to put these measures in place by 1 December 2010.
Some banks have challenged these new rules in court. The court is considering the arguments and may not reach a decision for some months. In the meantime, firms should go on assessing and answering PPI complaints. However, we are aware that some firms, including Lloyds TSB, have made a decision to cease handling PPI mis-selling complaints. In the interests of consumers, firms will be expected to continue handling complaints while the judicial review is ongoing.
If a firm tells you that it won't give you an answer to your PPI complaint until after the court case, then you can take your complaint directly to the Financial Ombudsman Service for a decision if you don't want to wait for the firm's future answer. The Financial Ombudsman Service's work deciding complaints is going on as normal and has not been affected by the court case.

Hi there,
I took a loan in 2006 from Santander (Abbey), still I am paying the loan with PPI every month. I never claimed it. Now i am thinking to pay off the full amount (Settlement figure) before third week of Dec.2010. Even if my loan account is closed, still can I claim PPI?. Already I contacted the bank couple of days ago, they said I can't claim PPI. But gone through this website and felt happy by seeing the information about the claim.
still can I claim the PPI? if I close my loan account.
Can any one or you please suggest me at it is a big amount for me.
