  • Di & Amersall. Thanks for your replies. I will give them a ring and let you know the outcome. I actually finished repaying the loan on 20th January, 2009, almost two years ago so the amount I get back should be the entire amount of the insurance which was £2,390.73 + their 8% = £2,581.99. Thanks again

    plus any interest that was charged on the initial premium (if the 2390 doesn't already include this)

  • Just spoken with MBNA and I have to admit they were fantastic. Not only were they helpful but the cheque is being issued and sent out by this Friday, 3rd December. The amount is also in excess of what I was expecting which is also a bonus. Thanks again to Amersall & Di. It was one of those things where you just wanted to hear from someone else and verify you were not wrong. Top Stuff

    Hi and welcome

    Sorry to hear that, but now its up to you of course.
    You do what you feel is best, but either way really its hard to give timescale on who will be quicker dealing with cases, you can sit it out if you want to in hope this won't be too long, but we just don't really know how long this Judicial Review issue will go on for as such.

    If you want to go to the FOS now, you are free to do so.

    Either way we wish you luck, please keep us posted. Cheers and fingers crossed.;)

    Hi there

    I received the exact same letter last week from MBNA and decided to phone the FOS who took my complaint over the phone. I have received the complaint and need to send it back signed to the FOS along with all relevant papwerwork. I just thought that I had nothing to lose by going to the FOS and think that MBNA are using this as a stalling technique!!

    I posted a comment quite a while back about raising a claim for PPI and after receiving 4 letters (Aug - Nov) each stating "we are investigating this and will be back in touch when we are finished" (or something similar) I am now complaining to the FOS.

    What I wondered is if I need to include a copy of my original loan agreement and should I include all the letters Yorkshire Bank have returned to me.

    I don't have a copy of the original loan agreement but I do have a copy of my last statement which shows loan and PPI amounts and the date it was taken out (11.09.03). It doesn't show interest paid.

    Sorry you had no result from them and i'm sure the FOS will sort this out for you now.

    What I did was send the FOS copies of all the evidence I had, this included a "copy of the final letter, anything in relation to the loan account" so that should be okay just as long as they have something to go by.

    Remember as well, there is a FOS complaints questionnaire on their website, or you can ring them to ask them to send you one via post.

    With regards to the questionaire, when I raised the complaint to Yorkshire Bank they sent me a similar questionaire to complete to allow them to investigate this, would you recommend completing another?

    Also I've not yet had a final answer from the bank but I've had 4 letters (one a month) stating they are still investigating this and will be back to me in time. The reason I now want to go to the FOS is because it's well outside the regulated 40 working days to resolve a complaint and I feel they are stalling for time.
