PPI Reclaiming Discussion part 4

Well after signing and sending back Lloyds TSB acceptance form for one of my ongoing loans I received the actual calculation of the PPI rebate today. This loan has just been transferred to the Debt Recovery Department (DRD) with a balance of approximately £15145.
What are farce.......... After spending the last 6 years making reduced payments (to the tune of around £10000) LLoyds believe that the difference between the loan with and without the PPI is only £2611. Despite me asking if they have taken all my payments in account they have refused to budge and said that this was their final offer. When I said that I will be going to the FOS they said
1. That I can't as I signed the acceptance form already. I explained that I only signed because I had to in order to receive the calculation. I was effectively told tough.
2. When I told them I previously was told the it was just routine for the 8% simple interest calculation and I could have it queried he denied it
3. When I insisted that I was going to the FOS he then said I couldn't because the money has already been sent, ie 8% interest to my account the rest to DRD. I replied that it hasn't reached my account yet, it would take 21 days and wanted it to be stopped, he retorted that it can't be stopped.
I have since sent an email to them explaining why the offer is not acceptable and as they refused to reconsider that I'm on record not accepting the offer and reserve my right to go to FOS.
My query is will the FOS reject my claim simply because I stupidly trusted Lloyds and signed the form without knowing the figures?0 -
If you want this refund paid off your loan, then i suggest that you ring them and tell them to do this before you sign the new loan agreement, otherwise theu will have to redo another loan agreement.x
Thanks guys, just want to be sure. Amersall ~ I already told them to take it off loan when they gave me the option. That's why I'm confused
I'll ring them and check I think. the best one is, some letters are coming addressed to my maiden name and some to married!! me thinks they may be a little confused too...!! lol0 -

Just re read your original post,
2nd letter, received today ~ New loan, restricted use to pay off remaining loan.
This sounds to me like they have taken your refund off your new loan, if you have a full breakdown of refund and how the loan was restructured then post on here so someone can take a look and maybe help you with this.If you have not got this, then ring them and get a full breakdown of new loan and old as to how they arrived at the figures.0 -
Received the letter in the post this morning from the adjudicator from the FOS - just to confirm the usual.
They are still continuing the investigations and will be in touch in due course.

LOL yeah and its been with them since last October, almost a year :eek: and this is actually another adjudicator as well.:D

I curently have 2 claims with the FOS awaiting adjudicators .1 against the RBS CC and the other is GM CC .Has anyone any experience, success or otherwise with similar complaints,purely claiming mis selling?
I was also wondering about time scales?

An update for all,
As I have said I have 2 cases with FOS and had some news this week all very conflicting so I thought Iwould share with you.
1. The case with RBS has not been upheld by the adjudicator, much to my dismay. I have had several discussions on the phone with him and several emails.However after all this time he has decided not to uphold my complaint against RBS stating "he thinks I was advised when I obtained my CC". As a result of this I have told him to pass it to the Obudsman and I will discuss it with him when he gets in touch with me. I was told this will take several months!! I must say I was very dissappointed with the adjudicator in the way he dealt with me.
1. The case against HFC has been upheld by the adjudicator and he has informed them of his decision and we await their agreement and hopefully a settlement figure.
Now then the thing is I claimed mis sell for the same reasons and cant understand why 1 has been upheld and the other hasnt???
1 reason given by the adjudicator who didnt agree with the RBS mis sell is the benefits offered which is b******s if I was sold something I didnt need or want.

I have read a few now of rejections by the FOS over the past few weeks, but keep at them anyway and hope the ombudsman himself turns this round in your favour in the end, fingers crossed.;)
