Thanks for all help so far. Here is my letter at moment. Is this ok?
I am writing in response to your letter dated 12th July 2010, with regards the insurance sold with my loan.Yourreference is **********

I do not feel your letter has offered a satisfactory justification that my policy was sold fairly, reasonably and within my best interests so I request that you look into my complaint again.

The loan provided was front loaded and I would pay this over loan term with interest and the policy only covered a few years. When I cancelled the PPI the loan only dropped £13, and not the £31 expected. (Natwest letter enclosed dated 23rd February 2009) I was not made aware of this when I took out the loan..

I was not told I could get my own PPI cover elsewhere. The person that dealt with the apllication rushed through the loan renegioation and did not fully explain all of my options (for example as a teacher I would receive cover through my Local Authority pay and conditions). I believe the FOS dont look too kindly on front loaded ppi insurance and uphold approx 99% of claims. And therefore I would Natwest/RBS to reconsider their decision.

If I do not receive a more favorable response within 14 days I shall be taking my complaint to the Financial Ombudsman.

    Yours faithfully,

Excellent, couldnt have put it better myself!! keep us posted on this and good luck x

    Hi

Yes I see what you mean now.
Ask them to send you a detailed written breakdown - they should do this if you request for this.

Normally they put it in a way, such as a goodwill offer - to put you back in the position if you did not have the PPI, or another way of a goodwill offer could just be that of an offer.

If they confirmed upholding your complaint, they should refund automatically all your PPI paid, and interest and also offer 8% interest on top of what a court would award for being deprived of your money.

Although a goodwill offer to put you back in the position, they can also offer the interest as well.

Hope this gives you some idea with this.;)

    Hi there

Further to the above, I did write back to MBNA and I asked for a full breakdown with 7 days and that I receive the refund (should I accept it) by personal cheque. I also enclosed a copy of a letter that I had sent to A&L asking for details of all insurance (the template letter on this site).

I got a letter back saying they are looking into it and I would receive a response within 28 days.

In the meantime, I have just received my next credit card statement and see that PPI of £1988.52 has been refunded to my account! So, it seems that they've ignored my request for a personal cheque and have just gone ahead with the refund.

This is a good thing, of course, but I have not yet received a full breakdown. Where does this leave me? Can anyone advise? Can I assume that I will still receive a full breakdown and could still take it further if I wish/need to?

Thanks again for all of your advice.

    Hi Rockbird

First of all, well done on your success.

However they should have in my opinion refunded the money as you previously requested.

May I ask that if any of the letters you received before they refunded your money stated how it was to be paid, despite you requesting for this?

    Cheers.:)

    Hi, thanks.

No the only letter I got was the one offering the 'goodwill gesture', which also stated that they would refund to my account and no further correspondence would be entered into. This was the letter that prompted my response above, requesting the full breakdown and cheque as well as a response to my initial request for details of insurance that I originally sent to A&L.

The letter I received following that request was dealt with, and signed by, a different case officer, so I am going to assume that they are going ahead with my request and that I will get the full breakdown and details of insurance going back (I had also sent the FOS questionnaire, btw, which is what, I think, prompted the 'goodwill gesture').

I guess it might be a good idea for me to await the response that has been promised within 28 days and go from there. I'm just a little concerned that there might be a time bar, though I can't seem to find anything to suggest there might be.

Do you think it's worth my asking for a refund by cheque, whereby they would put the PPI refund back on my account and then send me a cheque, or am I pushing my luck?

    Hi there

    I see.

Yes wait for the response that was promised to you and take if from there if you want to, and you could contact them and just question them on the refund matter, maybe they mistakenly overlooked your request, no harm in trying.;)

Thank you again! I might just contact them on Monday to see what they tell me.

And I'm just getting used to how this site works (just call me Luddite Lil!!!)
