Banks shouldnt be allowed to get away with this.
If i were you i would put a seperate complaint into fos and lloyds. about the length of time this has taken, and the problems with your health, dont know if this will help things along,but might make you feel better
I believe they get fined for each complaint? hope they do and at least you know they will have to pay.
When this is dealt with you need an extra payment for suffering, with the length of time etc

I dont want to complain to the FOS as I worry that it may affect the way that they treat my claim.
I have complained to Lloyds about the time taken and they, at first, had no record of my complaint. They eventually found it and said that a 'special department' deals with FOS complaints and they just wait to hear from the FOS and will not comment to me directly. They would not even tell me why they didnt respond when the adjudicator found in my favour.
They have now sent me a confirmation letter registering my phone complaint and saying that they will investigate my complaint about my complaint taking so long!!!!
How pathetic. Just sums up Lloyds TSB.0 -

I have just been informed that I am having to take a further pay cut at work and this, coupled with the debt left by my divorce, and the 2 and a half years since my complaint went to the ombudsman has left me on the verge of a nervous breakdown.
I am seeing the doctor again tomorrow and have phoned the FOS today to let them know the situation as well as sending them a confirmation letter.
I have offered them to see my doctors notes, my list of creditors, my finances, my medication.....basically whatever they want to see to confirm that I am not trying to pull the wool over their eyes in order to speed up the process.
The FOS does state that they will try to speed things up if...... The consumer would face particular financial difficulties because of any delay.
or Any delay would add significantly to the distress and inconvenience suffered by a consumer – or would have an adverse effect on their health.
I consider myself to be well and truly in both of these categories but there is little more that I can do now than cross fingers and toes in the hope that the process can speed up and the Ombudsman agrees with the adjudicator in my favour, and the redress from Lloyds can take me back to the times of sanity that at present seem such a distant memory.
I will keep you updated as to how things go.

Well the FOS should seriously take all this into consideration, they understand that the longer these issues are left, it does not help the situation at all, so they should I'm sure get on with this one pretty soon.

Now im not happy.
Complained to Black horse, they tell me in writing that they referred it to the original retailer.
I email retailer and they tell me Black horse have not been in contact.
Letter came from Black horse 2 weeks ago saying they had forwarded my complaint.
Now I see BH have a pretty bad record of dealing with complaints so have my suspicions theres something amiss here.0 -

Just starting out on this process with requests to my creditors for the terms and conditions on the loans I took out (complete with 1 pound cheque!!). I was wondering if I could pick the brains of some of you please?
I received replies from Egg (who I know I had PPI with) with the following response (note they returned the cheque):
"As the account is now closed we are under no obligation to comply with the request under the consumer credit act as we no longer have a contractual relationship relating to this account. The right to be provided with this information from Egg Banking PLC ended with the closure of the account."
Is this them just playing hardball? If so, I would be most gratfeul if anyone could advise what is my next step?

Hi there
I understand that if the account have been closed for some time, they do not always keep these actual details, but then again sometimes they can suddenly appear with a letter response, for instance if you write to complain it have been known that they enclose the agreement with a letter.
But.......
if you do not have any details of them at all, another way which they have to comply to is a Subject Access Request (SAR), they have 40 calendar days to send all the info they hold on you under the DPA, so what they still hold they must send.
There is a cost of £10 cheque or postal order payment for this.

It may be more difficult to retrieve any info going back further than 6 years.
For more on reclaiming, you complete a questionnaire, recently issued by the FOS, this is instead of a letter, they have 8 weeks in full to respond, you send to whom is responsible to mis selling you the policy, and keep a copy as well, in case you need to complain to the FOS later on.

That's a strange one isn't it?
You would of thought they would let you know who have taken over your case - in order to get in touch with them about your complaint.
Expecially more annoying if they orginally upheld your complaint as well.
Maybe you should put it into writing instead perhaps.
I do hope you hear something soon, but that is not fair that they don't put you in touch with the team manager, I would therefore write a letter and address it to the team manager, whoever that is, and post it by recorded delivery.The one and only "Dizzy Di"0
