    Hello there.

    Spent most of the afternoon on the phone to Alliance and Leicester about a loan I had in 2007, but which is paid off now.
    Anyway, when I finally got speaking to someone about PPI, he listened to my story:
    I took out a loan for around £19,000 in June 2007. I can remember that it was over the phone and that they did the hard sell on PPI, I must have just said ok just to get the loan through. When I got the paperwork to sign for the loan and saw the repayments including the PPI, I decided not to take it and didn't tick the box that I had to to take it up and sent away the documents hoping for the money to be paid in soon. A week or so later, they wrote back to me to tell me that I had agreed to take PPI and that the paperwork was incomplete and I had to tick the box for the PPI.
    I also took out a loan in 2006, but they were able to tell me from their records that it was on the internet and might not qualify. I said that when it come to applying for the loan online, I didn't choose PPI but then a screen came up telling me about its benefit (basically a very strong push).
    Now like most of us when applying for a loan, we are in need of the money and will do anything to speed the process up.
    Anyway, the guy on the phone said that my details would go before a review panel and that I would hear a decision within the next eight weeks.
    Is this normal? Will they just ultimately turn me down and force me to go down the legal route?
    Anyone any experiences of A&L?

    Hi there

    You DO have a very good chance of winning this reclaim and yes its 8 weeks they have.

    I would though if you have not done so (and only complained by telephone), put it into writing as well, tell them due to the telephone conversation (todays date) in regards of the ppi and write the account number, that you expect them to write to you with a decision by 8 weeks also as confirmed on the telephone.

    A&L were also fined to what I know of for mis selling PPI.

    I have looked at Martin's guideline for claiming PPI and would be grateful for any further clarification on a couple of points.
    The guide gives circumstances that PPI has likely been missold:
    1. "When you contact a lender by phone or in person if they don’t give you fair, correct and reasonable information it’s likely you were missold".
    -What if you didn't contact them by phone or in person but they only sent you an application form which you then complete and send back to them?
    2. "If you were already covered - for example you had a separate income protection policy or your employer provided an illness and redundancy package, and you informed the salesperson that you had this cover but they insisted you also had to take their insurance; or you weren't asked if you had any alternative cover".
    -Will a protection policy taken on your mortgage be classed as an alternative cover?
    3. "If you have an inappropriate PPI product and weren't told it was inappropriate or you don’t think you were given the full information on what the policy would and would not cover".
    -Will information on the lender's application form be classed as sufficient for the above purpose or should the lender have actually taken additional steps to confirm that the product was appropriate for your needs ?
    4. It then says "If you bought your loan or credit card online, reclaiming’s more difficult as the full T&Cs are usually available there".
    - Does this mean an application form sent to you by post will fall in the same category as online application if it contained the full terms and conditions ?
    Any clarification on the above points will be very much appreciated as I am paying a significant amount on PPI.

    Your welcome.

    1. It does not really matter how the application was taken out really, but if the application was completed at home, they may state that you opted to take out the PPI as you ticked for this protection, by completing the application yourself.
    (Okay, you may have completed the application at home), but did you actually tick to accept the PPI? - or maybe they had done this afterwards? perhaps.
    Or was the cover arranged separately to the application form?

    2. If you advised the seller you already had protection in place to cover you for the unfortunate - then it should have been optional, you should have had a choice, and they should not have pressurised you into taking the PPI out with them.
    I would check the policy you do have anyway to make sure - check what it protects you for in regards of your mortgage (this may just be for the mortgage only, unless you had cover such as Income protection to cover for all your requirements - all loans/credit cards and the mortgage etc.

    3. The seller should make sure the cover would suit all your requirements, for example - if you had a pre existing medical condition, and you made a claim for this reason later on, then the policy would not pay out.
    So basically the policy should have been advised to you, for your best interest.

    4. I have read that many on here have made applications online, and have still been successful.
    But it can be more difficult to reclaim as all the t&c's are or should be disclosed, but again if you did complete an application online, it is also known that many have not chosen to take out the PPI, and the application would not go through either.
    (So if you completed an application at home - and you are not aware of the PPI - can you remember how this ppi was actually sold to you)?
    Did they contact you by phone for this?

    If so it could be worth requesting for the copies of telephone recordings to help support your case.

    You could request a Subject Access Request (SAR) for further information, - which "may" be helpful, where details may be included about the application from when you taken this out.

    There is a SAR template on link below, for this you enclose £10 postal order or cheque payment. Its not absolutely essential to request a SAR, but it may be useful.
