    Hi there and your welcome.

    I know its a right pain, but what I would do is if you kept a copy is send to them again but post it by recorded delivery, you can then check the tracking of this on the Royal mail website "track and trace", they cannot deny receiving this then.

    Then ask them to send to the complaints dept, also make them aware you already sent a letter to them previously as well and would appreciate it if they could deal with your complaint for as soon as possible, as you've heard nothing at all.

    You could check though on the tel number you do have and ask them on whom should you write to.;)

    Hi All,

    With this being in the news lately I thought I'd try and get my claim with Lloyds sorted once and for all.

    I took out a credit card with Accucard prob around 5 or 6 years ago which I didn't have any PPI payments for. Around 4 years ago or so Lloyds took over the credit card account and it changed from Accucard to a Lloyds TSB Platinum Card.

    At this time I wasn't particularly good with money and didn't really know what state my finances were in. I just kept paying Lloyds in the same way I did Accucard.

    Fast forward to around 18 months ago- I finally started the process of getting debts in order (And have been successful on may counts except this one!). I wrote to Lloyds asking for 6 years of statements in order to claim back any excess charges as you could still do this with credit cards. I realised the debt I had with Lloyds hadn't actually been down to charges I thought I was getting - but in fact when the account switched from Accucard to Lloyds they suddenly began to charge me PPI on the account which I had never had before and never asked for.

    This happened on my account for a good two years before suddenly stopping.

    I followed the instructions on MSE for contacting the bank and suggesting this was wrong and that I wanted to claim back the PPI as I had never asked for it. I got letters saying Lloyds were looking into it and after a couple of months they wrote to say they believed I was asked in a phone conversation with the bank if I wanted PPI and I agreed. I know this didn't happen as I always made a point of never adding any extra payments as I wasn't affording what I already had to pay as it was. Nothing was ever sent to me to confirm this either.

    They then went on to say that had attempted to check their recorded calls/ written records and they were unable to find anything about the PPI and that because they had no evidence that I said no on the phone to someone selling me PPI then they had to assume that I had said yes (!!!) and that the complaint was not being upheld!!

    This seems an utterly absurd piece of logic to me!

    From here I meant to to take it forward but had lost heart a little and eventually it got forgotten about until now. I still have all the letters / account info and want to def claim back this money - it's prob around £350.

    On the letter they sent disregarding my claim they said I only had a certain time period to despute this or the case will be closed. Am i still able to follow this up?
    And also- where should I go from now? Another attempt at Lloyds as it's been so long- or straight to the ombudsman?

    I'd really appreciate the help. Of all the credit cards/ loans/ overdrafts I've managed to sort out over the past year and a half this is the only which is still not really going anywhere and the PPI reclaim would be a huge step to getting myself finally sorted and not worrying about money any more.

    hi there, you can put your complaint in again, the fos have asked companies to re look at claims that were not upheld, you go for it and good luck

    Hi there

    So sorry to hear this and this is LLoyds all over!

    They were probably worried in case you requested for a copy of the tel conversations that you would be entitled to under the DPA, and requesting a Subject access Request (SAR).

    I would not leave it there, and write back and give them 7 days to get back to you.

    Tell them your not satisfied with the outcome of their decision and its unfair that they should NOT uphold on your complaint when you given your reasons for being mis sold and all because they have lack of information to go by, its just not on, or should they have not gone by something they could not prove.

    I would then tell them your aware the FSA are investigating companies who have been rejecting complaints and for not investigating complaints properly - where you believe yours was not taken into any consideration.

    I would send them a letter in hard-copy to ask them to reconsider by 7 days, and also email them with a copy at this email address here, ask that they forward this on to the Customer Insurance Team and to confirm they have done this, and also make them aware an hard copy is on its way in the post - signed delivery.

    Hope this helps, if you hear nothing by 7 days, chase them up via email above, and tell them you will now have to decide to take to the FOS which will then incur them in paying out charges to the FOS if the ombudsman upholds in your favour.

    It helps just knowing that people agree that I've been treated completely wrongly. When they gave their final verdict I couldn't quite believe the reason they gave - this shocked me into thinking there was no chance really and no point in bothering.

    Well I'm going to pursue them now- Lloyds need to know they can't treat people like this.

  • i AM ATTEMPTING TO RECLAIM PPI CHARGES ON AN OLD A&L VISA CARD. I HAVE MANAGED TO FIND MOST OF THE OLD STATEMENTS GOING AS FAR BACK AS JANUARY 1999. DO I NEED TO KNOW THE EXACT DATE I TOOK OUT THE CARD. ALSO ON CHECKING OLD STATEMENTS MY ACCOUNT NUMBER APPEARS TO HAVE CHANGED 3 OR 4 TIMES. DO I DIRECT MY CLAIM TO A & L. DOES ANYONE KNOW ADDRESS TO SEND COMPLAINT TO, AND DO I USE ORIGINAL ACCOUNT NUMBER?

    Hi there

    Just as long as you have the account number details this does help, of course it does help that you have statements as well - in case you need to refer to them at some point.

    However for ppi reclaiming follow the guidelines of reclaiming, complete the FOS questionnaire, send to whom set up your finance, and keep copies.
    They have 8 weeks in full.

    For charges I believe this can be done separately to the actual reclaiming of the PPI itself, so you can check this out and post on this thread here if you want to in regards of the charges:

    So therefore you will have 2 separate claims and more money to come back.

    The address you need to write to is the St Williams House Cardiff one the full address is on the reply sent by Di.

    I sent them my letter of complaint (not registered post) on the 27th March 2010 and i had a letter back from them within 5 days stating they will look into my complaint.

    I think the fact that you have posted yours to your local office would suggest that it has just been lost in the system somewere.
