    Hello everybody,

I'm trying to reclaim what I believe to be missold insurance for two personel Egg loans.

The first loan was taken out in June 2003. I was told over the phone that I had to take the insurance to be eleigible. I topped this loan up in September 2008, this time I was not requested to take any insurance with the new loan agreement.

I again topped up this loan in May 2004 and this time I had to take the insurance. The loan was completely paid off in August 2008.

I have no paper work for any of these loans - just the account numbers - so I sent Egg a letter requsting copies of the credit agreements. They have replied saying:

"The right to be provided with this information ended with the closure of the account."

So I won't be getting a copy of the credit agreement. Is this fight over for me now? What should I do next?

I'd really appreciate any help or advice you guys could give me!
    -Susan

    Hi Susan and welcome

Did you actually for the documents by forms of a SAR (Subject Access Request)?
This is one where you enclose £10 postal order or a cheque payment and they have 40 calendar days to comply?
There is a SAR template letter here:
    https://forums.moneysavingexpert.com/discussion/1475553

Then if they are not able to supply anything they MUST return your payment and enclose a letter to explain why they cannot do this.
If they do still hold anything on you of any of the accounts its law of the Data protection act (DPA) they MUST supply the details.

So maybe its worth a go this way - then see what they come back with.

But otherwise write to reclaim anyway and see then what they have to say, because you do have the account numbers for each one of them that is fine.

You therefore complete separate complaint forms (recently issued by the Financial ombudsman service) FOS - keep copies of all in case you need to refer to them later on for some reason, and they have 8 weeks in full to respond.
You never know they may suddently find your details.;)
The questionnaire forms you will find on the guidelines of reclaiming link below, "stage one".
    http://www.moneysavingexpert.com/reclaim/ppi-loan-insurance

You can write cover letters if you want to, but its not essential, with these questionnaires being quite new, I understand it covers all grounds of PPI reclaiming.

Good luck, please keep us posted.;)

I am almost losing the will to fight

A year on since I sent the FOS my complaint about the RBOS PPI I am nowhere hearing a resoulution to this, they have contacted me stating they are still trying to allocate me an adjucator, quite frankly I am getting fed up with this never ending wait, RBOS are quick enough to grant themselves huge bonuses but sure as hell they like drag their heels in refunding what is quite rightly mine

Any suggestions as how to bring this matter to a conclusion?

I have 2 with the the FOS for RBS as well. (Been with FOS since Feb last year) The one has just been allocated to an adjudicator. He explained that there has been a delay with RBS complaints being allocated to adjudicators due to discussions between FOS and RBS senior management although he didn't know what talks were about or the outcome.

So hopefully yours should be with an adjudicator soon!

    Hang in there!

    January 2008, complained to FOS
January 2010, paperwork looked at by adjudicator
March 2010, paperwork now with an Ombudsman.....................
If I get to October it will be 3 years since I first put my complaint to Lloyds TSB.
Have told the FOS that I am now on blood pressure and cholesterol tablets due to stress and they are going as fast as they can.
The Lloyds customer care and Treating Customers Fairly ethos is totally non existent.
