PPI Reclaiming Discussion part 4

We purchased a new kitchen back in 2006, and we were sold a PPI as we were told it was compulsory, plus my husband's health issues would have made it invalid which was not explained. When I put in a claim using the pro forma letters from this site, I received a letter from Black Horse that they were not liable for the PPI as it was an independent company selling the kitchen and using Black Horse finance. The company was now out of business so therefore we would have no chance in reclaiming. What now? Any advice welcome.

Hi and welcome Helen
What you need to do now is ask them "who was responsible" as you will have to contact them.
They MUST give you the details.
You could meanwhile contact the financial ombudsman service (FOS) for advice where they may lead you in the right direction.

Do you know the name of the business that went bust?
And when?
Just wondering if they would be listed with the Financial compensation scheme (FSCS), if they are you should be able to make a claim through them.
Some of us have been that direction with reclaiming, so it maybe worth finding our who they are and asking the FSCS here:

If they are not, the FOS on the first link details I posted may suggest the actual insurer direction instead, so contact the FSCS first, and if this fails contact the FOS.

I am in need of some advice on how to start off this process and whether I am eligible.
I honestly cannot remember when I took the credit card out - I was young - probably early 20s - and accumulated some debt across cards and buried my head in the sand with it. More recently I have got everything under control and have started to clear the debts. Whilst doing so, I noticed on my card a £50 per month charge going to axa insurance, which was payment protection for the card. I phoned up Barclays and cancelled the policy.
Then I found this thread.
My issue is, when I first took this card it was with Morgan Stanley, at some point (as I said, I wasn't paying attention to the debt at the time), Barclays bought the cards and my account is in their hands. As payment is made to AXA and the card was originally taken out with Morgan Stanley, can I write to Barclays directly?
I don't remember signing up for something that would cost me that much per month, certainly if I would have known that, on a max'ed out card, I would be paying that much. It's certainly hurt me financially over the years and added to the difficulty in paying off the outstanding balance. However, I'm sure, "I don't remember doing it", wouldn't be a good enough reason to claim.
I really don't know where to start or whether I should actually be claiming. It was such a long time ago, that I signed the agreement for the card, that I don't have any of the original documentation. Nor do I have the AXA policy number - do I get this from Barclays?

Just as long as you still have the account number details you can continue to make a reclaim with the reasons you have.
You complete a Questionnaire recently issued by the financial ombudsman service (FOS), keep copies as well, and they have 8 weeks in full to respond.

Send to the ones who set this up for you from the start.
Post within the post office to receive proof of posting.
And keep at them, if they do not resolve in your favour, by the final decision then you can always then complain to the FOS.

Hi, i finaly got my ppi refund yesterday(£800) after a few months of sending my first letter, they put the refund straight into my current acount and and they ajusted my loan amount (£125 taken off the loan) so it was like i didnt have the ppi, my loan went down to about £500 when i checked my balance yesterday.
But today i got up to check my balance and now the loan says i owe them £1300, they gave me a ppi refund of £800 into my current account but put £800 onto my loan !!!!. this cant be right.
does anyone know what there doing ?

ive just recieved a reply to my first barclaycard letter with a questionnaire.
ive seen various posts about these but am still noyt sure of the best way to fill it in. I cant really remember the answers to most of the questions.
The letter also says that if they do not here from me within 10 days they will confirm closure of my complaint. any advice please??37,000 starts today0 -

This is procedure with most now.
Even the Financial ombudman service (FOS) have recently issued new questionnaires for customers to send to banks to reclaim on the PPI which is alternative to sending a letter.
However, what I would do is, "complete to the best of your knowledge".
Write next to the questions - Pleaser refer to my letter dated XX/XX/XXXX where you will note I have given my reasons.
Any questions on the sale of the policy - (Please refer to my account - from when you sold me the product).
Basically just do your best to complete all you can and all you can remember, but as you have already sent them a letter, send the questionnaire back to them with details given as shown above.
Probably a stalling tactic, but they MUST still deal with your complaint by 8 weeks they have.

In Janaury (26th) I sent my first letter of to them - the template letter - stating how it was missold and asking for it to be refunded. My last payment to them was in March 2010. I sent this to the branch address as this was the address on my paperwork and where I took out the loan.
I never received a reply so on April 19th I sent the second template letter again to the branch address asking for them to reply within 14 days. I still haven't heard anything from them.
Should I now contact the FOS? Should I have sent the letters to another address? I am surprised that I have never had any sort of response at all - what have other people's experiences been?

If so then contact the local branch and question them on this.
I would also as well check with the main head branch if they have one.
I have a few here but not certain on whom is the main contact.

No I didn't send either of them recorded delivery. I have looked for a number but all I can find is the same 0844 number which all the branches have listed. Where would I find the branches direct number? Or should just phone the number I have? The branch in question is the one in Gateshead.0
